Stat. tit. 36, § 36-4501","heading":"Eligible groups","body":"Group accident and health insurance is hereby declared to be\n\nthat form of accident and health insurance covering groups of\n\npersons as defined below, with or without one or more members of\n\ntheir families or one or more of their dependents, or covering one\n\nor more members of the families or one or more dependents of persons\n\nin such groups, and issued upon the following basis:\n\n1. Under a policy issued to an association, which has been in\n\nexistence for at least twelve (12) months, including a labor union,\n\nwhich shall have a constitution and bylaws and which has been\n\norganized and is maintained in good faith for purposes other than\n\nthat of obtaining insurance, insuring at least ten members,\n\nemployees, or employees of members of the association for the\n\nbenefit of persons other than the association or its officers or\n\ntrustees. The term \"employees\" as used herein shall be deemed to\n\ninclude retired employees;\n\n2. Under a policy issued to the trustees of a fund established\n\nby two or more employers or by one or more labor unions or by one or\n\nmore employers and one or more labor unions, which trustees shall be\n\ndeemed the policyholder, to insure employees of the employers or\n\nmembers of the unions for the benefit of persons other than the\n\nemployers or the unions. The term \"employees\" as used herein shall\n\nbe deemed to include the officers, managers and employees of the\n\nemployer, and the individual proprietor or partners if the employer\n\nis an individual proprietor or partnership. The term \"employees\" as\n\nused herein shall be deemed to include retired employees. The\n\npolicy may provide that the term \"employees\" shall include the\n\ntrustees or their employees, or both, if their duties are\n\nprincipally connected with such trusteeship;\n\n3. Under a policy issued to any persons or organizations to\n\nwhich a policy of group life insurance may be delivered in this\n\nstate, to insure any class or classes of individuals that could be\n\ninsured under such group life policy;\n\n4. Under a health insurance policy issued to an employer or\n\ntrustees of a fund established by an employer, who shall be deemed\n\nthe policyholder insuring at least one employee of such employer for\n\nthe benefit of persons other than the employer. The term \"employee\"\n\nas used herein shall be deemed to include the officers, managers,\n\nand employees of the employer, the individual proprietor or partners\n\nif the employer is an individual proprietor or partnership, the\n\nofficers, managers, and employees of subsidiary or affiliated\n\ncorporations, the individual proprietors, partners and employees of\n\nindividuals and firms, if the business of the employer and such\n\nindividual or firm is under common control through stock ownership,\n\ncontract, or otherwise. The term \"employee\" as used herein shall be\n\ndeemed to include retired employees and their dependents and the\n\ndependents of employees eligible for Medicare. A policy issued to\n\ninsure employees of a public body may provide that the term\n\n\"employees\" shall include elected or appointed officials;\n\n5. Under a policy issued to cover any other substantially\n\nsimilar group which, in the discretion of the Insurance\n\nCommissioner, may be subject to the issuance of a group accident and\n\nhealth policy or contract; and\n\n6.
