A health insurance policy delivered or issued for delivery\n\nin this state that provides for conversion to an individual policy\n\nby an insured on termination of membership in or employment with the\n\ngroup shall provide a conversion privilege to an individual policy\n\nto the spouse of the insured on death of the insured or on divorce\n\nfrom the insured or on termination of the insured's membership in or\n\nemployment with the group for any reason including retirement. If\n\nthe conversion privilege available to the insured provides for\n\ncoverage of the insured's spouse, the group insurer shall not be\n\nrequired to issue a separate conversion policy to the spouse.\n\nB. Subsection A of this section applies only to a spouse of an\n\ninsured if the spouse is covered under the health insurance policy\n\nat the time of the insured's death or divorce from the insured or\n\ntermination of the insured's coverage.\n\nC. This act applies to all health insurance policies that are\n\ndelivered or issued for delivery in this state on or after October\n\n1, 1981. Any presently approved policy forms containing any\n\nprovision in conflict with the requirements of this act may be\n\nbrought into compliance with this act by the use of riders and\n\nendorsements which have been approved by the Commissioner of\n\nInsurance.\n\nD. As used in this section:\n\n1. \"Health insurance policy\" means a group policy or contract\n\nproviding insurance for hospital, surgical, or medical expenses\n\nincurred as a result of an accident or sickness.\n\n2. \"Insured\" means an employee or member of a group that is\n\ncovered by a health insurance policy.\n\nE.
