Each Health Insurance Purchasing Group (HIPG), in\n\nconjunction with a HIPG health carrier, shall make available a\n\nhealth benefits plan in the manner described in this section to all\n\neligible employers and eligible employees at rates, including\n\nemployers’ and employees’ shares, on a policy- or product-specific\n\nbasis which may vary only as permitted under law.\n\nB. Subject to subsection C of this section, a HIPG shall not\n\noffer a health benefit plan which unfairly discriminates against\n\neligible employees.\n\nC. Nothing in this act shall be construed as requiring a HIPG\n\nhealth carrier to provide coverage outside the service area of the\n\ninsurer or organization.\n\nD. Each HIPG shall provide a health benefits plan only through\n\ncontracts with HIPG health carriers and shall not assume insurance\n\nrisk with respect to the coverage.\n\nE. Except as provided in this act, the HIPG may develop or\n\noffer a health benefits plan for its members, in whole or in part,\n\nnot subject to state-mandated health benefits.\n\nF. The HIPG shall offer at least two types of plans to its\n\nmembers, including one plan providing a choice of deductibles with\n\nstate-mandated health benefits.\n\nG. The HIPG may also offer a health benefits plan not subject\n\nto state-mandated health benefits which does not contain standard\n\nprovisions or rights required to be present in a health benefits\n\nplan pursuant to law or regulations unrelated to a specific illness,\n\ninjury or condition of the insured, for the provisions as may be\n\ndetermined by rules and regulations of the Commissioner.\n\nH. Every health benefits plan offered through a HIPG shall:\n\n1. Be underwritten by a HIPG health carrier that:\n\na. is licensed or otherwise regulated under state\n\nlaw,\n\nb. meets all applicable state standards relating to\n\nconsumer protection, including, but not limited\n\nto, state solvency and market conduct, and\n\nc. offers the coverage under an approved contract\n\nwith the HIPG;\n\n2. Be approved or otherwise permitted to be offered under law;\n\n3. Provide full portability of creditable coverage for\n\nindividuals who remain members of the same HIPG notwithstanding that\n\nthey change the eligible employer through which they are members;\n\nand\n\n4. Comply with the provisions of the Oklahoma Insurance Code in\n\ntheir sales and solicitation of insurance including, but not limited\n\nto, the Trade Practices Act, and to the degree that an agent is\n\ninvolved in the solicitation, sale or purchase of a health benefits\n\nplan offered to a HIPG, that agent must be duly licensed by the\n\nState Insurance Department and hold a valid license to transact the\n\nbusiness of insurance.\n\nI. A HIPG shall be subject to the requirements of the Small\n\nEmployer Health Insurance Reform Act.\n\nJ. Nothing in this act shall be construed as precluding a HIPG\n\nhealth carrier from offering a health benefits plan through a HIPG\n\nby establishing premium discounts for members, or from modifying\n\notherwise applicable copayments or deductibles in return for\n\nadherence to programs of health promotion and disease prevention, so\n\nlong as the programs are agreed to in advance by the HIPG and comply\n\nwith all other provisions of this act and do not discriminate among\n\nsimilarly situated members.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"89c1483ead8a40f7a7cfd5034c3a49be38e6000760be84cd7750d4f277ccc6ed","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-4523","next":"us-ok/okla.-stat.-tit.-36-36-4525"},"notice":"GroundRules: Original legal text.
