Stat. tit. 36, § 36-4528","heading":"Areas served – Services and plans permitted to be offered","body":"by single administrative organization – Rating characteristics.\n\nA. Nothing in this act shall be construed as preventing one or\n\nmore Health Insurance Purchasing Groups (HIPG) from serving\n\ndifferent areas, whether or not contiguous, by providing for some or\n\nall of the following through a single administrative organization or\n\notherwise:\n\n1. Coordinating the offering of the same or similar health\n\nbenefits coverage in different areas served by the different HIPG;\n\nor\n\n2. Providing for crediting of deductibles and other cost-\n\nsharing for individuals who are provided a health benefits plan\n\nthrough the HIPG or affiliated HIPG after:\n\na. a change of eligible employers through which the\n\ncoverage is provided, or\n\nb. a change in place of employment to an area not served\n\nby the previous HIPG.\n\nB. No HIPG health carrier shall be required to offer HIPG\n\nhealth benefits plans, or health benefits plans not subject to\n\nstate-mandated health benefits, to non-HIPG organizations,\n\nassociations, or employer groups, including but not limited to the\n\nsmall employer health insurance group marketplace in this state.\n\nC. Nothing in this act shall be construed as precluding a HIPG\n\nfrom providing for adjustments in amounts distributed among the HIPG\n\nhealth carriers offering a health benefits plan through the HIPG,\n\nbased on factors such as the relative health care risk of members\n\nenrolled under the coverage offered by the different issuers.\n\nD. Nothing in this act shall be construed as precluding a HIPG\n\nfrom establishing minimum participation and contribution rules for\n\neligible employers that apply to become purchasers in the HIPG, so\n\nlong as the rules are applied uniformly for all HIPG health\n\ncarriers.\n\nE. The HIPG may determine what rating characteristics it will\n\nallow in the health benefit plan including, but not limited to, age,\n\nsex, industry, geography, or health.\n\nF.
