This act shall be known and may be cited as the \"Health Care\n\nEmpowerment Act\".\n\nB. Nothing in state law shall be construed as prohibiting a\n\npatient or legal representative from seeking care outside of an\n\ninsurance plan, or outside of the Medicaid or Medicare program, and\n\npaying for such care.\n\nC. Nothing in state law shall be construed as prohibiting a\n\nphysician, other medical professional or a medical facility from\n\naccepting payment for services or medical products outside of an\n\ninsurance plan. Nothing in state law shall be construed as\n\nprohibiting a physician, other medical professional or a medical\n\nfacility from accepting payment for services or medical products to\n\na Medicaid or Medicare beneficiary, provided that such physician,\n\nmedical professional or medical facility has opted out of Medicare.\n\nAs used in this section, \"medical products\" include, but are not\n\nlimited to, medical drugs and pharmaceuticals.\n\nD. A patient or legal representative shall not forfeit\n\ninsurance benefits, Medicaid benefits or Medicare benefits by\n\npurchasing medical services or medical products outside the system.\n\nE. The offer and provision of medical services or medical\n\nproducts purchased and provided under this act shall not be deemed\n\nan offer of insurance nor regulated by the insurance laws of the\n\nstate.\n\nF.
