There is hereby created in the State Treasury a revolving\n\nfund for the Insurance Department, to be designated the \"State-based\n\nExchange Revolving Fund\". The fund shall be a continuing fund, not\n\nsubject to fiscal year limitations, and shall consist of any monies\n\ndeposited to the fund for the creation, implementation,\n\nadministration, and operation of the State-based Exchange as\n\nauthorized in subsection A of Section 1 of this act. All monies\n\naccruing to the credit of the fund are hereby appropriated and may\n\nbe budgeted and expended by the Department for the creation,\n\nimplementation, administration, and operation of the State-based\n\nExchange. Warrants for expenditures from the revolving fund shall\n\nbe drawn by the State Treasurer, based on claims signed by an\n\nauthorized employee or employees of the Insurance Department, and\n\nfiled with the Director of the Office of Management and Enterprise\n\nServices.\n\nB. Notwithstanding any law to the contrary, all monies,\n\nincluding but not limited to user fees, paid to or collected by the\n\nInsurance Commissioner in relation to the State-based Exchange shall\n\nbe deposited in the State-based Exchange Revolving Fund.
