Stat. tit. 36, § 36-5001","heading":"Certificates of authority — Persons not deemed title","body":"insurers — Issuance of policies.\n\nA. Any foreign or domestic stock insurer authorized by its\n\ncorporate charter to engage in business as a title insurer shall be\n\nentitled to the issuance of a certificate of authority as a title\n\ninsurer in this state upon meeting the applicable requirements of\n\nArticle 6, Authorization of Insurers and General Requirements, of\n\nthe Oklahoma Insurance Code, except that existing title insurers may\n\nhave their certificate of authority renewed by maintaining surplus\n\nin regard to policyholders of not less than Five Hundred Thousand\n\nDollars ($500,000.00).\n\nB. A person engaged in the business of preparing or issuing\n\nabstracts of, but not guaranteeing or insuring, title to property,\n\nor a person acting only as a title insurance producer appointed by a\n\ntitle insurer, shall not be deemed to be a title insurer.\n\nC. Every commitment and policy of title insurance issued by any\n\ninsurance company authorized to do business in this state shall be\n\ncountersigned by some person, partnership, corporation or agency\n\nactively engaged in the real estate title business and maintaining\n\nan office in the state, who is a duly appointed a title insurance\n\nproducer for a title insurance company holding a valid license and\n\nauthorized to do business in the state; provided, that no commitment\n\nor policy of title insurance shall be issued in the State of\n\nOklahoma except:\n\n1. After examination by an attorney licensed to practice in\n\nthis state of a duly certified abstract extension or supplemental\n\nabstract prepared by an abstractor licensed in the county where the\n\nproperty is located, from a certified abstract plant in the county\n\nwhere the property is located or per a temporary certificate of\n\nauthority as provided in Section 33 of Title 1 of the Oklahoma\n\nStatutes, from the effective date of a prior owner's policy of title\n\ninsurance issued by a title insurer licensed in this state provided\n\nby the insured, the prior title insurance producer or the prior\n\ntitle insurer, at the time a valid order is placed pursuant to the\n\nprovisions of the Oklahoma Abstractors Law brought forward to the\n\neffective date of the abstract plant. Subject to the conditions and\n\nstipulations, the exclusions from coverage, exceptions from coverage\n\nand endorsements to the policy, any policy issued based on a prior\n\nowner's policy and a supplemental abstract shall insure the insured\n\nagainst loss or damage sustained or incurred by reason of\n\nunmarketability of title from sovereignty to the effective date of\n\nthe policy, not to exceed the amount of insurance stated in the\n\npolicy; or\n\n2. If a prior owner's policy of title insurance is not\n\nprovided, then a title insurance commitment and policy may be issued\n\nafter examination by an attorney licensed to practice in this state\n\nof a duly certified abstract of title prepared by a bonded and\n\nlicensed abstractor as defined in the Oklahoma Abstractors Law.\n\nD. If the current owner or insured, or the owner's or insured's\n\nauthorized agent requests, in writing, a copy of any previously\n\nissued owner's policy, the title insurance producer or the title\n\ninsurer that issued the policy shall provide the requesting party\n\nwith a copy of the schedules in the previously issued policy, at no\n\ncharge, within three (3) business days, unless there exists an\n\nunavoidable delay.\n\nE. As used in this section, the term \"representative\" shall\n\nmean a person authorized to act on behalf of or in place of another\n\nin the current transaction.\n\nF. Every title insurance producer, title insurer or person who\n\nconducts a real estate closing that presents, for filing in the\n\noffice of the county clerk, an instrument of conveyance or vesting\n\ntitle in connection with a transaction in which an owner's policy of\n\ntitle insurance is to be issued by a title insurance producer or\nct on behalf of or in place of another\n\nin the current transaction.\n\nF. Every title insurance producer, title insurer or person who\n\nconducts a real estate closing that presents, for filing in the\n\noffice of the county clerk, an instrument of conveyance or vesting\n\ntitle in connection with a transaction in which an owner's policy of\n\ntitle insurance is to be issued by a title insurance producer or\n\ntitle insurer that is based upon such instrument shall place a\n\nlegend within the instrument that sets forth the following\n\ninformation:\n\nDeed presented for filing by: [Name of title insurance\n\nproducer, title insurer or person conducting closing]\n\nFile Number: [File Number of title insurance producer, title\n\ninsurer or person conducting closing]\n\n[Name of Title Insurer designated in the Commitment for Title\n\nInsurance]\n\nG. The Insurance Department shall maintain, for each title\n\ninsurance producer or title insurer holding a valid license and\n\nauthorized to do business in the state, contact information for the\n\noffice or person responsible for making available copies of owner's\n\npolicies pursuant to this statute and shall make such contact\n\ninformation generally available to the public on its website and by\n\ntelephone request.\n\nH.
