A reinsurance intermediary, insurer or reinsurer found by\n\nthe Insurance Commissioner, after notice and opportunity for a\n\nhearing conducted in accordance with the Administrative Procedures\n\nAct, to be in violation of any provision of the Reinsurance\n\nIntermediary Act, shall:\n\n1. For each separate violation, pay a penalty in an amount not\n\nexceeding Five Thousand Dollars ($5,000.00); and\n\n2. Be subject to revocation or suspension of license.\n\nB. In addition, if a violation of the Reinsurance Intermediary\n\nAct is committed by a reinsurance intermediary, such reinsurance\n\nintermediary shall make restitution to the insurer, reinsurer,\n\nrehabilitator or liquidator of the insurer or reinsurer for the net\n\nlosses incurred by the insurer or reinsurer attributable to such\n\nviolation.\n\nC. The decision, determination, or order of the Commissioner\n\npursuant to this section shall be subject to judicial review\n\npursuant to the Administrative Procedures Act.\n\nD. Nothing contained in this section shall affect the right of\n\nthe Commissioner to impose any other penalties provided in the\n\nOklahoma Insurance Code.\n\nE.
