Any policy, contract or agreement issued or renewed by an\n\ninsurer, as defined in Section 6054 of Title 36 of the Oklahoma\n\nStatutes, or any contract or agreement issued or renewed for any\n\npreferred provider or other provider arrangement or managed care\n\nplan, which requires the insured or enrollee to make a copayment\n\nwhen benefits are provided, shall disclose to the insured or\n\nenrollee the calculation for the copayment. In no case shall the\n\ncopayment be based on a higher figure than either the amount billed\n\nor the amount paid, whichever is less. This subsection shall apply\n\nto any health insurance plan offered through the State and Education\n\nEmployees Group Insurance Act.\n\nB. Any insurer, hospital or licensed health care provider\n\ndetermined to be in violation of subsection A of this section by the\n\nInsurance Commissioner, the State Board of Health or the appropriate\n\nhealth care professional licensing entity, after notice, shall be\n\nsubject to an administrative fine of not less than One Thousand\n\nDollars ($1,000.00) or more than Five Thousand Dollars ($5,000.00)\n\nfor each violation. Notice under this section shall include a\n\nstatement of violations on which the fine is based and notice of the\n\nopportunity for a hearing.\n\nC. The Insurance Commissioner, the State Board of Health or the\n\nappropriate health care professional licensing entity shall\n\npromulgate rules providing for enforcement of the provisions of this\n\nact. In addition, each entity may promulgate rules providing for\n\nsuspension or revocation of a license for substantial failure to\n\ncomply with the provisions of this act.
