Stat. tit. 36, § 36-6057.1","heading":"Examination and enforcement by Commissioner –","body":"Attorneys’ fees.\n\nA. In order to enforce the provisions of the Health Care\n\nFreedom of Choice Act, the Insurance Commissioner may conduct an\n\nexamination of insurers’ and preferred provider organizations’\n\nclaims files pursuant to the procedure set forth in Section 1250.4\n\nof this title.\n\nB. The Commissioner, upon finding an insurer in violation of\n\nany provision of the Health Care Freedom of Choice Act, may issue a\n\ncease and desist order to the insurer directing the insurer to stop\n\nsuch unlawful practices. If the insurer refuses or fails to comply\n\nwith the order, the Commissioner shall have the authority to revoke\n\nor suspend the insurer’s certificate of authority. The Commissioner\n\nshall use the authority specified in this subsection to the extent\n\ndeemed necessary to obtain the insurer’s compliance with the order.\n\nThe Attorney General shall offer assistance if requested by the\n\nCommissioner to enforce the Commissioner’s orders.\n\nC. Reasonable attorney fees shall be awarded to the\n\nCommissioner if judicial action is necessary for the enforcement of\n\nthe orders. Such fees shall be based upon those prevailing in the\n\ncommunity. Fees collected by the Commissioner without the\n\nassistance of the Attorney General shall be credited to the\n\nInsurance Commissioner’s Revolving Fund.
