Stat. tit. 36, § 36-6057.5","heading":"Surgical Patient Choice Task Force – Appointment of","body":"members – Meetings – Reimbursement of travel expenses –\n\nRecommendations and report.\n\nA. There is hereby created to continue until February 1, 2006,\n\nthe Surgical Patient Choice Task Force.\n\n1. The Task Force shall consist of ten (10) members.\n\n2. Of the ten members:\n\na. three shall be appointed by the Speaker of the\n\nOklahoma House of Representatives as follows:\n\n(1) one shall be a representative of a health insurer\n\nwhich owns or operates a statewide provider\n\nnetwork,\n\n(2) one shall represent a specialty hospital, and\n\n(3) one shall be a member of the Oklahoma House of\n\nRepresentatives and shall serve as cochair,\n\nb. three shall be appointed by the President Pro Tempore\n\nof the State Senate as follows:\n\n(1) one shall represent an ambulatory surgical\n\ncenter,\n\n(2) one shall represent a statewide hospital\n\nassociation, and\n\n(3) one shall be a member of the State Senate and\n\nshall serve as cochair,\n\nc. two shall be appointed by the Governor as follows:\n\n(1) one shall be a representative of a full-service\n\ncommunity hospital located in a community with a\n\npopulation of over three hundred thousand\n\n(300,000), and\n\n(2) one shall represent a hospital located in a rural\n\narea, and\n\nd. two shall be public sector representatives or their\n\ndesignees as follows:\n\n(1) the Commissioner of the State Department of\n\nHealth, and\n\n(2) the Insurance Commissioner.\n\nB. 1. Appointed members of the Task Force shall serve at the\n\npleasure of their appointing authority.\n\n2. A vacancy on the Task Force shall be filled by the original\n\nappointing authority.\n\n3. Appointments to the Task Force shall be made by August 1,\n\n2005.\n\nC. 1. A majority of the members present at a meeting shall\n\nconstitute a quorum to do business.\n\n2. The cochairs of the Task Force shall convene the first\n\nmeeting of the Task Force on or before September 1, 2005, at which\n\ntime a schedule of the meetings shall be determined.\n\n3. The Oklahoma Insurance Department shall provide staff\n\nsupport for the Task Force.\n\nD. The Task Force may divide into subcommittees in furtherance\n\nof its purposes.\n\nE. Members of the Task Force shall receive no compensation but\n\nshall be reimbursed for necessary travel expenses incurred in the\n\nperformance of their duties pursuant to the provisions of the State\n\nTravel Reimbursement Act as follows:\n\n1. Legislative members of the Task Force shall be reimbursed in\n\naccordance with the provisions of Section 456 of Title 74 of the\n\nOklahoma Statutes; and\n\n2. Nonlegislative members of the Task Force shall be reimbursed\n\nby their appointing authorities.\n\nF. The purpose of the Task Force shall be to make\n\nrecommendations to the Legislature and the Governor regarding ways\n\nto improve patient access to rural hospitals, specialty hospitals\n\nand ambulatory surgical centers by:\n\n1. Studying the issue of the exclusion of hospitals including\n\nspecialty hospitals and ambulatory surgical centers from health\n\ninsurance plans when those facilities are willing to meet the terms\n\nof a contract set forth and offered to similar providers by health\n\ninsurance companies;\n\n2. Determining whether a need exists to expand opportunities\n\nfor hospitals to participate in health insurance provider networks;\n\n3. Determining if patients have the ability to choose among and\n\nbetween all geographically relevant providers which meet\n\nrequirements set by insurance companies;\n\n4. Determining if providers as defined in this act who are not\n\nallowed to participate in provider networks are denied participation\n\nbased on issues related to patient safety, sound economic policies,\n\nand the practice of medicine;\n\n5. Making recommendations as to the role of the State Insurance\n\nCommission and the State Department of Health in establishing a\n\nsystem of appeal when a hospital, specialty hospital, or ambulatory\n\nsurgical center, is denied participation in a provider network; and\networks are denied participation\n\nbased on issues related to patient safety, sound economic policies,\n\nand the practice of medicine;\n\n5. Making recommendations as to the role of the State Insurance\n\nCommission and the State Department of Health in establishing a\n\nsystem of appeal when a hospital, specialty hospital, or ambulatory\n\nsurgical center, is denied participation in a provider network; and\n\n6. Identifying other issues deemed appropriate by the Task\n\nForce.\n\nG.
