All individual and group health insurance policies providing\n\ncoverage on an expense incurred, fixed, or capitated basis, and all\n\nindividual and group insurance policies, certificates, service or\n\nindemnity type contracts issued by insurance companies, health\n\nmaintenance organizations, nonprofit corporations, or charitable and\n\nbenevolent corporations established for the purpose of operating a\n\nnonprofit hospital service, indemnity, fixed or capitated plan, or a\n\nnonprofit medical or indemnity plan, and all self-insurers which\n\nprovide coverage for a family member of the insured or subscriber\n\nshall, as to such family member's coverage, also provide that the\n\nhealth insurance benefits applicable for children shall be payable\n\nwith respect to a newly born child of the insured or subscriber from\n\nthe moment of birth.\n\nB. The coverage for newly born children shall consist of\n\ncoverage of injury or sickness including the necessary care and\n\ntreatment of medically diagnosed congenital defects and birth\n\nabnormalities. Such coverage shall also include transportation\n\nnecessary for the provision of medical care for such newly born\n\nchildren when (1) the newly born is transported to the nearest\n\nhospital capable of providing the medically necessary treatment on a\n\ntimely basis, and (2) the mode of transportation is the most\n\neconomical consistent with the well-being of the newly born.\n\nTransportation coverage shall not exceed the reasonable costs of\n\nproviding such service and an itemized statement of costs shall\n\naccompany each claim.\n\nThe provisions of this subsection shall not apply to policies\n\ninvolving Medicare and supplements to Medicare.\n\nC. If payment of a specific premium or subscription fee is\n\nrequired to provide coverage for a child, the policy or contract may\n\nrequire that notification of birth and payment of the required\n\npremium or fees must be furnished to the insurer or nonprofit\n\nservice or indemnity corporation within thirty-one (31) days after\n\nthe date of birth in order to have the coverage continue beyond such\n\nthirty-one-day period.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"357cfff3cb52bf03a348b7632227fcc1de2a334f13a557571c35c8d28fc65cc1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6057.5","next":"us-ok/okla.-stat.-tit.-36-36-6058a"},"notice":"GroundRules: Original legal text.
