All individual and group health insurance policies providing\n\ncoverage on an expense incurred, fixed, or capitated basis, and all\n\nindividual and group insurance policies, certificates, service or\n\nindemnity type contracts issued by insurance companies, health\n\nmaintenance organizations, nonprofit corporations, charitable and\n\nbenevolent corporations established for the purposes of operating a\n\nnonprofit hospital service or indemnity plan and/or a nonprofit\n\nmedical or indemnity, fixed, or capitated plan, and all self-\n\ninsurers which provide coverage for a family member of the insured\n\nor subscriber shall, as to such family member's coverage, also\n\nprovide that the health insurance benefits applicable for any\n\nnatural child of the insured or subscriber shall be payable with\n\nrespect to any adopted child of the insured or subscriber from the\n\ndate of placement of the child in the custody of the insured or\n\nsubscriber, provided the insurer is notified within thirty-one (31)\n\ndays in writing. Coverage shall include the necessary care and\n\ntreatment of medical conditions existing prior to the date of\n\nplacement of the child in the custody of the insured or subscriber.\n\nNothing in this section shall be construed to require coverage of\n\ncosts incurred for such medical conditions prior to the date of\n\nplacement of the child in the custody of the insured or subscriber.\n\nB. Subject to the terms and conditions of the policy, contract\n\nor agreement, coverage shall also include the actual and documented\n\nmedical costs associated with the birth of an adopted child who is\n\neighteen (18) months of age or younger. If requested, the insured\n\nshall provide copies of medical bills and records associated with\n\nthe birth of the adopted child and proof that the insured paid or is\n\nresponsible for payment of the medical bills associated with the\n\nbirth and that the cost of the birth was not covered by another\n\nhealth care plan including Medicaid. Any reference to the name of\n\nthe natural parents of the adopted child shall be deleted from the\n\nrecords so provided. The coverage required by this subsection shall\n\nbe subject to the same annual deductibles and coinsurance as may be\n\ndeemed appropriate and as are consistent with those established for\n\nother covered benefits. The coverage shall also be subject to the\n\nterms of the insurers contract, if any, with hospitals and\n\nphysicians.\n\nC. As used in this section, \"placement\" means the assumption by\n\nthe insured or subscriber of the physical custody of the adopted\n\nchild and the financial responsibility for the support and care of\n\nthe adopted child.\n\nD. For purposes of this section, a child who is in the custody\n\nof the insured, pursuant to an interlocutory decree issued under\n\nSection 7505-6.1 of Title 10 of the Oklahoma Statutes vesting\n\ntemporary care of the child in the insured, is an adopted child\n\nduring the pendency of the adoption proceeding, regardless of\n\nwhether a final decree of adoption is ultimately issued.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7b6509238f86e0e50d24bccfb0b3992ffc16d1de880a3997672669f2891ffe69","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6058a","next":"us-ok/okla.-stat.-tit.-36-36-606"},"notice":"GroundRules: Original legal text.
