No person shall act as an insurer and no insurer shall\n\ntransact insurance in Oklahoma except as authorized by a subsisting\n\nauthority granted to it by the Insurance Commissioner, except as to\n\nsuch transactions as are expressly otherwise provided for in this\n\nCode.\n\nB. No such authority shall be required for an insurer, formerly\n\nso licensed in Oklahoma and now licensed in another state as a\n\nresident insurer or who has merged with an insurer in another state,\n\nto enable it to investigate and settle losses under its policies\n\nlawfully written in Oklahoma, or to liquidate such assets and\n\nliabilities of the insurer (other than collection of new premiums)\n\nas may have resulted from its former authorized operations in\n\nOklahoma.\n\nC. An insurer, who has relocated in another state or has merged\n\nwith an insurer in another state and is not transacting new\n\ninsurance business in Oklahoma but continuing collection of premiums\n\non and servicing of policies remaining in force as to residents of\n\nor risks located in Oklahoma, is transacting insurance in Oklahoma\n\nfor the purpose of premium tax requirements only and is not required\n\nto have a certificate of authority therefor. This subsection shall\n\nnot apply to insurers which have withdrawn from Oklahoma prior to\n\nthe effective date of this Code.\n\nD. As to an insurance coverage on a subject of insurance not\n\nresident, located, or expressly to be performed in Oklahoma at time\n\nof issuance, and solicited, written, and delivered outside Oklahoma\n\nat the time of issuance, no such authority shall be required of an\n\ninsurer as to subsequent transactions in Oklahoma on account\n\nthereof, and the provisions of this Code shall not apply to such\n\ninsurance or insurance coverage, except for the purpose of premium\n\ntax requirements.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bee632cd5507cf9b70e9d5e1e8c961e6c90946c090dd6b048a14259c40e3b89a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6059","next":"us-ok/okla.-stat.-tit.-36-36-606.1"},"notice":"GroundRules: Original legal text.
