A health benefit plan that, at the end of its base period,\n\nexperiences a greater than two percent (2%) increase in premium\n\ncosts pursuant to providing benefits for treatment of mental health\n\nand substance use disorders shall be exempt from the provisions of\n\nSection 6060.11 of this title.\n\n2. To calculate base-period-premium costs, the health benefit\n\nplan shall subtract from premium costs incurred during the base\n\nperiod, both the premium costs incurred during the period\n\nimmediately preceding the base period and any premium cost increases\n\nattributable to factors unrelated to benefits for treatment of\n\nmental health and substance use disorders.\n\n3. a. To claim the exemption provided for in paragraph 1 of\n\nthis section a health benefit plan shall provide to\n\nthe Insurance Commissioner a written request signed by\n\nan actuary stating the reasons and actuarial\n\nassumptions upon which the request is based.\n\nb. The Commissioner shall verify the information provided\n\nand shall approve or disapprove the request within\n\nthirty (30) days of receipt.\n\nc.
