Stat. tit. 36, § 36-6060.22","heading":"Exemption for health benefit plans from autism","body":"spectrum disorder coverage.\n\nA. 1. A health benefit plan that, at the end of its base\n\nperiod, experiences a greater than one percent (1%) increase in\n\npremium costs pursuant to providing applied behavior analysis for\n\ntreatment of autism spectrum disorders shall be exempt from the\n\nprovisions of this act.\n\n2. To calculate base-period-premium costs, the health benefit\n\nplan shall subtract from premium costs incurred during the base\n\nperiod, both the premium costs incurred during the period\n\nimmediately preceding the base period and any premium cost increases\n\nattributable to factors unrelated to benefits for treatment of\n\nautism spectrum disorders.\n\n3. a. To claim the exemption provided for in subsection A of\n\nthis section a health benefit plan shall provide to\n\nthe Insurance Commissioner a written request signed by\n\nan actuary stating the reasons and actuarial\n\nassumptions upon which the request is based.\n\nb. The Commissioner shall verify the information provided\n\nand shall approve or disapprove the request within\n\nthirty (30) days of receipt.\n\nc. If, upon investigation, the Commissioner finds that\n\nany statement of fact in the request is found to be\n\nknowingly false, the health benefit plan may be\n\nsubject to suspension or loss of license or any other\n\npenalty as determined by the Commissioner, or the\n\nState Commissioner of Health with regard to health\n\nmaintenance organizations.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"74e95f39b13aea18b3abde2e469516a9bc5d6a6ebf96b3d3e6f8a137da5548d4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6060.21","next":"us-ok/okla.-stat.-tit.-36-36-6060.3"},"notice":"GroundRules: Original legal text.
