Any health benefit plan that provides coverage and\n\nbenefits for cancer treatment shall provide coverage of prescribed\n\norally administered anticancer medications on a basis no less\n\nfavorable than intravenously administered or injected cancer\n\nmedications.\n\n2. Coverage of orally administered anticancer medication shall\n\nnot be subject to any prior authorization, dollar limit, copayment,\n\ndeductible, or other out-of-pocket expense that does not apply to\n\nintravenously administered or injected cancer medication, regardless\n\nof formulation or benefit category determination by the company\n\nadministering the health benefit plan.\n\n3. A health benefit plan shall not reclassify or increase any\n\ntype of cost-sharing to the covered person for anticancer\n\nmedications in order to achieve compliance with this section. Any\n\nchange in health insurance coverage that otherwise increases an out-\n\nof-pocket expense to anticancer medications shall also be applied to\n\nthe majority of comparable medical or pharmaceutical benefits\n\ncovered by the health benefit plan.\n\n4. A health benefit plan that limits the total amount paid by a\n\ncovered person through all cost-sharing requirements to no more than\n\nOne Hundred Dollars ($100.00) per filled prescription for any orally\n\nadministered anticancer medication shall be considered in compliance\n\nwith this section. For purposes of this paragraph, \"cost-sharing\n\nrequirements\" shall include copayments, coinsurance, deductibles,\n\nand any other amounts paid by the covered person for that\n\nprescription.\n\nB. As used in this section:\n\n1. \"Anticancer medications\" means medications used to kill or\n\nslow the growth of cancer cells;\n\n2. \"Covered person\" means a policyholder, subscriber, enrollee,\n\nor other individual enrolled in or insured by a health benefit plan\n\nfor health insurance coverage; and\n\n3. \"Health benefit plan\" means any plan or arrangement as\n\ndefined in subsection C of Section 6060.4 of Title 36 of the\n\nOklahoma Statutes.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"08f8db8814cf57cd99c3b3256dce040fe86d8d55628e585a31d84e1c5058926a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6060.9","next":"us-ok/okla.-stat.-tit.-36-36-6060.9b"},"notice":"GroundRules: Original legal text.
