Stat. tit. 36, § 36-6103.3","heading":"Engaging in the business of insurance without statutory","body":"authorization - Remedies of Insurance Commissioner.\n\nA. For the purposes of Sections 6103.1 through 6103.11 of this\n\ntitle, \"person\" shall include an individual, a partnership, a\n\ncorporation, a limited liability company, an association, a joint\n\nstock company, a trust, an unincorporated organization, any similar\n\ngroup, entity or any combination of the foregoing acting in concert.\n\nB. No person or insurer shall directly or indirectly do any of\n\nthe acts of an insurance business set forth in Sections 6103.1\n\nthrough 6103.11 of this title, except as provided by and in\n\naccordance with the specific authorization of statute. In respect\n\nto the insurance of subjects resident, located or to be performed\n\nwithin this state, this section shall not prohibit the collection of\n\npremium or other acts performed outside of this state by persons or\n\ninsurers authorized to do business in this state provided such\n\ntransactions and insurance contracts otherwise comply with statute.\n\nC. Any person which the Insurance Commissioner has reason to\n\nbelieve is doing any of the acts specified in Section 6103.2 of this\n\ntitle, upon written request by the Commissioner, shall immediately\n\nprovide to the Commissioner such information as requested in\n\nrelation to such acts.\n\nD. A person or entity who violates any provision of Sections\n\n6103.1 through 6103.11 of this title is subject to a civil penalty\n\nof not more than Ten Thousand Dollars ($10,000.00) for each act of\n\nviolation and for each day of violation to be recovered as provided\n\nin this section.\n\nE. Whenever the Commissioner has reason to believe or it\n\nappears that any person or insurer has violated or is threatening to\n\nviolate any provision of Sections 6103.1 through 6103.11 of this\n\ntitle or any rule promulgated pursuant thereto, or that any person\n\nor insurer acting in violation of Sections 6103.1 through 6103.11 of\n\nthis title has engaged in or is threatening to engage in any unfair\n\nmethod of competition or any unfair or deceptive act or practice as\n\ndefined by Section 1201 et seq. of this title or any rule\n\npromulgated pursuant thereto, the Commissioner may:\n\n1. Issue an ex parte cease and desist order under the\n\nprocedures provided by Sections 6103.5 and 6103.6 of this title;\n\n2. Institute in the district court of Oklahoma County a civil\n\nsuit for injunctive relief to restrain the person from continuing\n\nthe violation or threat of violation;\n\n3. Institute in the district court of Oklahoma County a civil\n\nsuit to recover a civil penalty as provided for in this section; or\n\n4. Exercise any combination of the acts provided for in this\n\nsubsection.\n\nF. On application for injunctive relief and a finding that a\n\nperson is violating or threatening to violate any provision of\n\nSections 6103.1 through 6103.11 of this title, the district court\n\nshall grant the injunctive relief and the injunction shall be issued\n\nwithout bond.\n\nG. The remedies provided in Sections 6103.1 through 6103.11 of\n\nthis title for administrative action against unauthorized insurers\n\nshall also apply to unauthorized individuals or persons engaged in\n\nthe business of bail bonds or any other business which is subject to\n\nthe jurisdiction of the Insurance Commissioner.\n\nH. This section shall not be construed to limit the Insurance\n\nCommissioner to the remedies specified herein. It is the intent of\n\nthe Legislature that persons engaging in the business of insurance,\n\nor any other business for which authorization from the Insurance\n\nCommissioner is required, without statutory authorization constitute\n\nan imminent peril to the public welfare and should immediately be\n\nstopped and enjoined from doing so, provided, the Insurance\n\nCommissioner and the State of Oklahoma should be able to choose at\n\nany time any available remedy or action to bring about such a result\n\nwithout regard to prior proceedings under this section.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"732412f2f73fb015baf58e770ba2598cc955df37b05437d590da808a3e579790","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6103.2","next":"us-ok/okla.-stat.-tit.-36-36-6103.4"},"notice":"GroundRules: Original legal text.
