If the Insurance Commissioner reasonably believes that a\n\nperson has violated a cease and desist order issued under Sections\n\n6103.1 through 6103.11 of this title, the Commissioner may:\n\na. initiate individual proceedings under this section\n\npursuant to the Administrative Procedures Act,\n\nb. initiate proceedings to revoke the certificate of\n\nauthority of the person affected by a ruling or action\n\nissued under Sections 6103.1 through 6103.11 of this\n\ntitle, or\n\nc. pursue any other action the Commissioner deems\n\nappropriate under applicable law.\n\n2. In determining whether a cease and desist order has been\n\nviolated, the Commissioner shall consider the maintenance of\n\nprocedures reasonably adopted to ensure compliance with the order.\n\nThe hearing shall be conducted according to the procedure for\n\ncontested cases under the Administrative Procedures Act.\n\nB. After a hearing, if the Commissioner determines that a cease\n\nand desist order has been violated, the Commissioner may:\n\n1. Impose a civil penalty of Twenty-five Thousand Dollars\n\n($25,000.00) for each act of violation;\n\n2. Direct the person against whom the order was issued to make\n\ncomplete restitution, in the form and amount and within the period\n\ndetermined by the Commissioner, to all Oklahoma residents, Oklahoma\n\ninsureds, and entities operating in Oklahoma damaged by the\n\nviolation or failure to comply; or\n\n3. Both impose the penalty and direct restitution.\n\nC. A person aggrieved by a final order or decision of the\n\nCommissioner pursuant to Sections 6103.1 through 6103.11 of this\n\ntitle may seek judicial review pursuant to Section 318 of Title 75\n\nof the Oklahoma Statutes.
