Applications for a permit shall be filed electronically with\n\nthe Insurance Commissioner, in the manner and form prescribed by the\n\nInsurance Commissioner, and shall at the time of filing include a\n\nfiling fee of Fifty Dollars ($50.00) along with any transaction or\n\nother applicable fees. The Insurance Commissioner may issue a\n\npermit upon:\n\n1. The receipt of the application and payment of the filing\n\nfee;\n\n2. Determination that the organization is in good standing with\n\nthe Oklahoma Funeral Board; and\n\n3. Making a finding that the organization has complied with\n\nthis act and the rules promulgated under this act by the Insurance\n\nCommissioner. All applications shall be signed by the organization\n\nrequesting the permit, and shall contain a statement that the\n\norganization will comply with all the requirements as established by\n\nthis act. All permits shall expire annually on December 31, unless\n\nrenewed; permits may be renewed for a period not to exceed the\n\nsucceeding December 31 upon the payment of a renewal fee of Fifty\n\nDollars ($50.00). A permit expired for failure to submit a renewal\n\napplication may be reinstated within ninety (90) days after the\n\nexpiration date by electronically submitting a fee in an amount that\n\nis double the renewal fee and a renewal application in the form and\n\nmanner prescribed by the Insurance Commissioner, along with any\n\ntransaction or other applicable fees. A permit holder whose permit\n\nhas been expired for more than ninety (90) days shall reapply as if\n\nthey were a new applicant and pay an application fee equal to an\n\namount that is double the renewal fee in addition to any fines\n\nimposed. All applications received after the permit has been\n\nexpired for more than ninety (90) days shall include a detailed\n\nreport in the form and manner prescribed by the Insurance\n\nCommissioner of any prepaid funeral benefits offered or provided in\n\nthis state during the period of the expired permit.\n\nB. The Insurance Commissioner may suspend, revoke, or refuse to\n\nrenew a permit or refuse to issue a permit for failure to comply\n\nwith any provision of this act, or any valid rule, which the\n\nInsurance Commissioner has promulgated, after reasonable notice and\n\nopportunity for a hearing. When the Insurance Commissioner suspends\n\nor revokes a permit or refuses to issue a renewal of a permit for a\n\nviolation, the Insurance Commissioner shall notify the Oklahoma\n\nFuneral Board of the action and the nature of any violations.\n\nC. No organization shall be entitled to a new permit for a\n\nperiod of one (1) year after revocation or refusal by the Insurance\n\nCommissioner to issue or renew the permit of the organization, but\n\nshall thereafter be entitled to a new permit upon satisfactory proof\n\nof compliance with this law after the expiration of the one-year\n\nperiod.\n\nD.
