Issuance of a certificate of authority for a prepaid dental\n\nplan organization shall be granted by the Commissioner if the\n\nCommissioner is satisfied that the following conditions are met:\n\n1. The persons responsible for conducting the business affairs\n\nof the prepaid dental plan organization are competent and\n\ntrustworthy and are professionally capable of providing or arranging\n\nfor the provision of services offered; and\n\n2. The prepaid dental plan organization constitutes an\n\nappropriate mechanism to achieve an effective prepaid dental plan;\n\nand\n\n3. Each officer, responsible for conducting the business\n\naffairs of the prepaid dental plan organization, has filed with the\n\nCommissioner a fidelity bond in the amount of Fifty Thousand Dollars\n\n($50,000.00), said bond to be subject to the approval of the\n\nCommissioner; and\n\n4. The financial structure of the prepaid dental plan\n\norganization may reasonably be expected to meet obligations for\n\npayment of services for members and prospective members. In making\n\nthis determination the Commissioner may consider:\n\na. the financial soundness of the arrangements made\n\npursuant to the provisions of the prepaid dental plan for services\n\nand the schedule of charges used; and\n\nb. any agreement with an insurer, a hospital, a\n\nmedical service corporation, or any other organization for ensuring\n\nthe payment of prepaid dental services; and\n\nc. provisions in the plan for automatic coverage of\n\ndental service if the prepaid dental plan is discontinued; and\n\nd. the sufficiency of the agreement for prepaid\n\ndental services with providers of dental services.\n\nB. A certificate of authority shall expire at midnight on June\n\n30, following the date of issuance or last renewal date. If the\n\nprepaid dental plan organization remains in compliance with the\n\nprovisions of the Prepaid Dental Plan Act and pays a renewal fee of\n\nOne Hundred Dollars ($100.00), the certificate of authority of said\n\nplan may be renewed.
