The Commissioner may suspend or revoke any certificate of\n\nauthority issued to a prepaid dental plan organization pursuant to\n\nthe provisions of the Prepaid Dental Plan Act if the Commissioner\n\nfinds that any of the following conditions exist:\n\n1. The prepaid dental plan organization is operating contrary\n\nto the basic organizational documents of the organization or is\n\noperating in a manner contrary to that described in, and reasonably\n\ninferred from, any other information submitted pursuant to Section\n\n6144 of this title;\n\n2. The prepaid dental plan organization issued membership\n\ncoverage which does not comply with the requirements of Section 6148\n\nof this title;\n\n3. The prepaid dental plan does not provide or arrange for\n\nbasic dental services appropriate to a prepaid dental plan;\n\n4. The prepaid dental plan organization can no longer be\n\nexpected to meet obligations to members or prospective members of\n\nthe prepaid dental plan;\n\n5. The prepaid dental plan organization, or any authorized\n\nperson acting on behalf of the organization, has advertised or\n\nmerchandised services offered by said organization in an untrue,\n\nmisleading, deceptive, or unfair manner;\n\n6. The prepaid dental plan organization fails to deal equitably\n\nwith any dentists, dental physicians, technicians, or other persons\n\nor facilities whose services are covered within a contract or policy\n\nfor prepaid dental insurance; or\n\n7. The prepaid dental plan organization has failed to\n\nsubstantially comply with the provisions of the Prepaid Dental Plan\n\nAct or any rules and regulations promulgated thereunder.\n\nB. When the certificate of authority of a prepaid dental plan\n\norganization is suspended, the organization shall not accept, during\n\nthe period of such suspension, any additional members except newly\n\nacquired dependents of existing members and shall not engage in any\n\nadvertising or solicitation.\n\nC. When the certificate of authority of a prepaid dental plan\n\norganization is revoked, the organization shall proceed to terminate\n\noperation of the organization immediately and shall conduct no\n\nfurther business except as may be essential to the orderly\n\nconclusion of the business affairs of the organization. The\n\nCommissioner, by written order, may permit such further operation of\n\nthe organization as the Commissioner finds to be in the best\n\ninterest of members of the organization.\n\nD. If a certificate of authority is suspended or revoked\n\npursuant to the provisions of this section, the Commissioner may\n\ninvoke a fine not exceeding One Thousand Dollars ($1,000.00) for\n\neach violation. The payment of the fine may be enforced in the same\n\nmanner as civil judgments may be enforced.\n\nE. A prepaid dental plan organization which has had its\n\ncertificate of authority denied, suspended, or revoked, or has\n\nsuffered an adverse decision by the Commissioner, shall be entitled\n\nto a hearing pursuant to the provisions of the Administrative\n\nProcedures Act, Sections 301 through 326 of Title 75 of the Oklahoma\n\nStatutes.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fcc275d766bc330530e4e9f117426c8c094e5760cb126edbe05d3dd9628618fd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6153","next":"us-ok/okla.-stat.-tit.-36-36-6155"},"notice":"GroundRules: Original legal text.
