No advertising or sales material relating to a prepaid\n\ndental plan organization shall be issued or delivered to any person\n\nin this state until a copy of said material has been filed with and\n\napproved by the Commissioner. Within thirty (30) days after\n\nsubmission of said advertising or sales material, the Commissioner\n\nshall either approve the advertising or sales material, or shall\n\ndisapprove it should he determine that in whole or in part said\n\nmaterial is false, deceptive, or misleading. If the Commissioner\n\ndisapproves any advertising or sales material he shall give written\n\nnotification to the person who submitted the material. Thereafter,\n\nsuch advertising or sales material shall not be used by any person.\n\nViolation of the provisions of this subsection shall entitle the\n\nCommissioner in his discretion and without additional cause to\n\nwithdraw approval of any membership coverage with respect to which\n\nsaid advertising or sales material is used.\n\nB. Offers to sell prepaid dental insurance by advertising or\n\npublication of material by prepaid dental plan organizations or\n\nanyone acting on behalf of the organization to inform members and\n\npotential members of the plan as to the coverage offered by the plan\n\nand the operation of the organization shall not be a violation of\n\nany provisions of law relating to solicitation of customers or\n\nadvertising by prepaid dental plan providers, if the advertising or\n\nsales material:\n\n1. is approved prior to use, by the Commissioner upon\n\ndetermination by the Commissioner that the advertising or sales\n\nmaterial is not inaccurate, false, deceptive, or misleading; and\n\n2. does not identify the providers of dental services nor\n\ndescribe their professional qualifications, except upon the request\n\nof the member or potential member; and\n\n3. does not describe the professional experience or attainments\n\nof providers of dental services individually or as a group, or\n\ncontain language that states, evaluates or lauds the professional\n\ncompetence, skills or reputations of such providers; and\n\n4. shall not cause any providers of dental services to violate\n\nany professional ethics or laws prohibiting the solicitation of\n\npatients.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4a96d50a9d042afc190a7797a749634b49fa98e305c1644758e02f51e7990632","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6155","next":"us-ok/okla.-stat.-tit.-36-36-6157"},"notice":"GroundRules: Original legal text.
