Stat. tit. 36, § 36-6202","heading":"Definitions","body":"As used in the Insurance Adjusters Licensing Act:\n\n1. \"Commissioner\" means the Insurance Commissioner of the state\n\nor his or her lawfully authorized representative;\n\n2. \"Adjuster\" means either an insurance adjuster or a public\n\nadjuster;\n\n3. \"Insurance adjuster\" means any person, firm, association,\n\ncompany, or legal entity that acts in this state for an insurer, and\n\nthat investigates claims, adjusts losses, negotiates claim\n\nsettlements, or performs incidental duties arising pursuant to the\n\nprovisions of insurance contracts on behalf of an insurer and\n\nincludes:\n\na. \"independent adjusters\", meaning any insurance\n\nadjuster that suggests or presents to the insurance\n\nindustry and public that said adjuster acts as an\n\nadjuster for a fee or other compensation, and\n\nb. \"company or staff adjusters\", meaning adjusters who\n\nengage in the investigation, adjustment, and\n\nnegotiation of claims as salaried employees of an\n\ninsurer;\n\n4. \"Public adjuster\" means any person, firm, association,\n\ncompany, or corporation that suggests or presents to members of the\n\npublic that said public adjuster represents the interests of an\n\ninsured or third party for a fee or compensation. Public adjusters\n\nmay investigate claims and negotiate losses to property only;\n\n5. \"Insurer\" means any authorized insurance company,\n\ncorporation, reciprocal group, mutual group, underwriting\n\nassociation or bureau, or any combination thereof, writing or\n\nunderwriting any insurance contracts;\n\n6. “Home state” means the District of Columbia and any state or\n\nterritory of the United States in which the adjuster’s principal\n\nplace of residence or principal place of business is located. If\n\nneither the state in which the adjuster maintains the principal\n\nplace of residence nor the state in which the adjuster maintains the\n\nprincipal place of business has a licensing or examination\n\nrequirement, the adjuster may declare another state which has an\n\nexamination requirement and in which the adjuster is licensed to be\n\nthe “home state”; and\n\n7. “Automated claims adjudication system” means a preprogrammed\n\ncomputer system designed for the collection, data entry, calculation\n\nand final resolution of consumer electronic products insurance\n\nclaims which:\n\na. may only be utilized by a licensed independent\n\nadjuster, licensed agent, or individuals supervised by\n\na licensed independent adjuster or licensed agent,\n\nb. shall comply with all claims payment requirements of\n\nthe Oklahoma Insurance Code, and\n\nc. shall be certified as compliant by a licensed\n\nindependent adjuster.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f9ef479eb1d632f79a9b2cdcd32826e0d883cac49f048b6f856926ff929a8f85","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6201","next":"us-ok/okla.-stat.-tit.-36-36-6203"},"notice":"GroundRules: Original legal text.
