In the event of a catastrophe, the Insurance Commission may\n\ndeclare an emergency to exist, and in the event of such a\n\ndeclaration, the Commissioner may issue a license as an emergency\n\nadjuster to any resident or nonresident applicant. Such declaration\n\nof emergency may be made per zip code or on a county-by-county\n\nbasis, or any combination thereof. An individual licensed as an\n\nemergency adjuster pursuant to this section may only adjust claims\n\nrelated to the catastrophe. The applicant shall not have to be a\n\nlicensed adjuster. An applicant for this license shall be certified\n\nin the manner prescribed by the Commissioner by an adjuster licensed\n\nin this state or by an insurer who maintains an office in this state\n\nand is licensed to do business in this state. A licensed adjuster\n\nor insurer who certifies an applicant for this license shall be\n\nresponsible for any losses caused by the applicant or for any\n\nimproper claim handling practices committed by the applicant. The\n\nemployer of this applicant shall certify the application for license\n\nas an emergency adjuster to the Commissioner within five (5) days\n\nafter the applicant begins working as an emergency adjuster for the\n\nemployer. The license as an emergency adjuster shall remain in\n\nforce for not more than ninety (90) days from the date the\n\nCommissioner issues an emergency declaration order. The emergency\n\ndeclaration order may be extended an additional ninety (90) days at\n\nthe Commissioner's discretion. An emergency adjuster may only\n\nadjust claims resulting from the particular catastrophe for which\n\nthe emergency declaration order is issued.\n\nB. The Commissioner may suspend or revoke the right of any\n\nperson acting as an adjuster or an emergency adjuster in this state\n\npursuant to the authority derived from the provisions of the\n\nInsurance Adjusters Licensing Act to continue to adjust claims in\n\nthis state after a hearing on the suspension or revocation if the\n\nCommissioner finds that said person has engaged in any of the\n\npractices forbidden to a licensed adjuster. Notice of the hearing\n\non said suspension or revocation shall be given personally or shall\n\nbe sent by mail to the address stated in the registration. A\n\nduplicate copy of the notice shall be given to the insurer.\n\nC. No public adjuster shall charge, agree to or accept as\n\ncompensation or reimbursement any payment, commission, fee or other\n\nthing of value equal to more than ten percent (10%) of the amount of\n\nthe insurance settlement claim paid by the insurer on any claim\n\nresulting from a catastrophe declared by the Commissioner to be an\n\nemergency pursuant to subsection A of this section.
