Stat. tit. 36, § 36-640","heading":"Denial, suspension or revocation of license - Corrective","body":"action plans - Rescission or modification of suspension order.\n\nA. The Insurance Commissioner shall deny, suspend or revoke a\n\nMEWA's license if, after notice and opportunity for a hearing, the\n\nCommissioner finds that the MEWA:\n\n1. Is insolvent;\n\n2. Is using such methods and practices in the conduct of its\n\nbusiness as to render its further transaction of business in this\n\nstate hazardous or injurious to its participating employees, covered\n\nemployees and dependents, or to the public;\n\n3. Has failed to pay any final judgment rendered against it in\n\na court of competent jurisdiction within sixty (60) days after the\n\njudgment became final;\n\n4. Is or has been in violation of any material provisions of\n\nthis act;\n\n5. Is no longer actuarially sound; or\n\n6. Is charging rates that are excessive, inadequate or unfairly\n\ndiscriminatory.\n\nB. The Commissioner may deny, suspend or revoke the license of\n\nany MEWA if, after notice and opportunity for a hearing, the\n\nCommissioner determines that the MEWA:\n\n1. Has violated any lawful order or rule of the Commissioner or\n\nany applicable provisions of this act;\n\n2. Has refused to produce its accounts, records or files for\n\nexamination under Sections 309.1 through 310A.3 of this title or\n\nthrough any of its officers has refused to give information with\n\nrespect to its affairs or to perform any other legal obligation as\n\nto an examination;\n\n3. Utilized persons to solicit enrollments through an\n\nunlicensed agent; or\n\n4. Has violated any provision of the Unfair Claims Settlement\n\nPractices Act, Section 1250.1 et seq. of this title.\n\nC. Whenever the financial condition of the MEWA is such that,\n\nif not modified or corrected, its continued operation would result\n\nin impairment or insolvency, in addition to any provisions in this\n\nact, the Commissioner may order the MEWA to file with the\n\nCommissioner and implement a corrective action plan designed to\n\ncorrect such impairment or insolvency.\n\nIf the MEWA fails to submit a plan within the time specified by the\n\nCommissioner or submits a plan that is insufficient, the\n\nCommissioner may order the MEWA to implement corrective actions as\n\nnecessary to correct the MEWA's financial condition.\n\nD. The Commissioner shall, in any order suspending the\n\nauthority of a MEWA to enroll new insureds, specify the period\n\nduring which the suspension is to be in effect and the conditions,\n\nif any, that must be met prior to reinstatement of its authority to\n\nenroll new insureds. The order of suspension is subject to\n\nrescission or modification by further order of the Commissioner\n\nbefore the expiration of the suspension period.
