Stat. tit. 36, § 36-6458","heading":"Notice to Commissioner - Designation and registration of","body":"agent.\n\nA. A purchasing group which intends to do business in this\n\nstate shall, prior to doing business, furnish to the Insurance\n\nCommissioner notice which shall, on forms prescribed by the National\n\nAssociation of Insurance Commissioners:\n\n1. Identify the state in which the group is domiciled;\n\n2. Identify all other states in which the group intends to do\n\nbusiness;\n\n3. Specify the lines and classifications of liability insurance\n\nwhich the purchasing group intends to purchase;\n\n4. Identify the insurance company or companies from which the\n\ngroup intends to purchase its insurance and the domicile of the\n\ncompany or companies;\n\n5. Identify the principal place of business of the group;\n\n6. Specify the method by which the person or persons, if any,\n\nthrough whom insurance will be offered to its members whose risks\n\nare resident or located in this state; and\n\n7. Provide such other information as may be required by the\n\nCommissioner of this state to verify that the purchasing group is\n\nqualified to do business in this state as a purchasing group.\n\nB. A purchasing group shall notify the Insurance Commissioner\n\nof any changes in any of the information prescribed in subsection A\n\nof this section within ten (10) days of such change;\n\nC. The purchasing group shall register with and designate the\n\nCommissioner of this state as its agent solely for the purpose of\n\nreceiving service of legal documents or process, for which a filing\n\nfee shall be assessed in an amount determined by the Commissioner,\n\nexcept that such requirements shall not apply in the case of a\n\npurchasing group which only purchases insurance that was authorized\n\nunder the federal Products Liability Risk Retention Act of 1981 and:\n\n1. Which:\n\na. was domiciled before April 1, 1986, and\n\nb. is domiciled on and after October 27, 1986, in any\n\nstate;\n\n2. Before October 27, 1986, purchased insurance from an\n\ninsurance carrier licensed in any state;\n\n3. Since October 27, 1986, purchased its insurance from an\n\ninsurance carrier licensed in any state; or\n\n4. Was a purchasing group pursuant to the requirements of the\n\nfederal Product Liability Risk Retention Act of 1981 before October\n\n27, 1986.\n\nD. Each purchasing group that is required to give notice\n\npursuant to subsection A of this section also shall furnish such\n\ninformation as may be required by the Insurance Commissioner or\n\ndesignee to:\n\n1. Verify that the entity qualifies as a purchasing group;\n\n2. Determine where the purchasing group is located; and\n\n3.
