Stat. tit. 36, § 36-6470.13","heading":"Examination by Insurance Commissioner -","body":"Confidentiality - Application.\n\nA. At least once in five (5) years, and whenever the Insurance\n\nCommissioner determines it to be prudent, the Commissioner\n\npersonally, or a competent person appointed by the Commissioner,\n\nshall conduct an examination under Sections 309.1 through 309.7 of\n\nthis title, as well as determine whether the captive insurer has\n\ncomplied with the Oklahoma Captive Insurance Company Act. The\n\nCommissioner upon application, in his or her discretion, may enlarge\n\nthe five-year period to seven (7) years. The expenses and charges\n\nof the examination must be paid in accordance with the payment\n\nprovisions of Sections 309.1 through 309.7 of this title.\n\nB. All examination reports, preliminary examination reports or\n\nresults, working papers, recorded information, documents and copies\n\nof documents produced by, obtained by, or disclosed to the\n\nCommissioner or any other person in the course of an examination\n\nmade under this section are confidential and are not subject to\n\nsubpoena and may not be made public by the Commissioner or an\n\nemployee or agent of the Commissioner without the written consent of\n\nthe company, except to the extent provided in this subsection.\n\nNothing in this subsection prevents the Commissioner from using this\n\ninformation in furtherance of the regulatory authority of the\n\nCommissioner under the Oklahoma Captive Insurance Company Act. The\n\nCommissioner may grant access to this information to public officers\n\nhaving jurisdiction over the regulation of insurance in any other\n\nstate or country, or to law enforcement officers of this state or\n\nany other state or agency of the federal government at any time, so\n\nlong as the officers receiving the information agree in writing to\n\nhold it in a manner consistent with this section.\n\nC. 1. This section applies to all business written by a\n\ncaptive insurance company; however, the examination for a branch\n\ncaptive insurance company must be of branch business and branch\n\noperations only, as long as the branch captive insurance company\n\nprovides annually to the Commissioner a certificate of compliance,\n\nor its equivalent, issued by or filed with the licensing authority\n\nof the jurisdiction in which the branch captive insurance company is\n\nformed and demonstrates to the satisfaction of the Commissioner that\n\nit is operating in sound financial condition in accordance with all\n\napplicable laws and regulations of that jurisdiction.\n\n2.
