The Insurance Commissioner shall approve independent review\n\norganizations eligible to be assigned to conduct external reviews\n\nunder the Uniform Health Carrier External Review Act.\n\nB. In order to be eligible for approval by the Commissioner\n\nunder this section to conduct external reviews under the Uniform\n\nHealth Carrier External Review Act an independent review\n\norganization:\n\n1. Except as otherwise provided in this section, shall be\n\naccredited by a nationally recognized private accrediting entity\n\nthat the Commissioner has determined has independent review\n\norganization accreditation standards that are equivalent to or\n\nexceed the minimum qualifications for independent review\n\norganizations established under Section 6475.13 of this title; and\n\n2. Shall submit an application for approval in accordance with\n\nsubsection D of this section.\n\nC. The Commissioner shall develop an application form by rule\n\nfor initially approving and for reapproving independent review\n\norganizations to conduct external reviews.\n\nD. 1. Any independent review organization wishing to be\n\napproved to conduct external reviews under this act shall submit the\n\napplication form and include with the form all documentation and\n\ninformation necessary for the Commissioner to determine if the\n\nindependent review organization satisfies the minimum qualifications\n\nestablished under Section 6475.13 of this title.\n\n2. a. Subject to subparagraph b of this paragraph, an\n\nindependent review organization is eligible for\n\napproval under this section only if it is accredited\n\nby a nationally recognized private accrediting entity\n\nthat the Commissioner has determined has independent\n\nreview organization accreditation standards that are\n\nequivalent to or exceed the minimum qualifications for\n\nindependent review organizations under Section 6475.13\n\nof this title.\n\nb. The Commissioner may approve independent review\n\norganizations that are not accredited by a nationally\n\nrecognized private accrediting entity if there are no\n\nacceptable nationally recognized private accrediting\n\nentities providing independent review organization\n\naccreditation.\n\n3. The Commissioner may charge an application fee that\n\nindependent review organizations shall submit to the Commissioner\n\nwith an application for approval and reapproval.\n\nE. 1. An approval is effective for two (2) years, unless the\n\nCommissioner determines before its expiration that the independent\n\nreview organization is not satisfying the minimum qualifications\n\nestablished under Section 6475.14 of this title.\n\n2. Whenever the Commissioner determines that an independent\n\nreview organization has lost its accreditation or no longer\n\nsatisfies the minimum requirements established under Section 6475.14\n\nof this title, the Commissioner shall terminate the approval of the\n\nindependent review organization and remove the independent review\n\norganization from the list of independent review organizations\n\napproved to conduct external reviews under the Uniform Health\n\nCarrier External Review Act that is maintained by the Commissioner\n\npursuant to subsection F of this section.\n\nF. The Commissioner shall maintain and periodically update a\n\nlist of approved independent review organizations.\n\nG.
