A small employer carrier may establish a class of business\n\nonly to reflect substantial differences in expected claims\n\nexperience or administrative costs related to the following reasons:\n\n1. The small employer carrier uses more than one type of system\n\nfor the marketing and sale of health benefit plans to small\n\nemployers;\n\n2. The small employer carrier has acquired a class of business\n\nfrom another small employer carrier; or\n\n3. The small employer carrier provides coverage to one or more\n\nassociation groups that meet the requirements of an association as\n\nset forth in Section 4501 of this title.\n\nB. A small employer carrier may establish up to nine separate\n\nclasses of business under subsection A of this section.\n\nC. The Insurance Commissioner may establish rules to provide\n\nfor a period of transition in order for a small employer carrier to\n\ncome into compliance with subsection B of this section in the\n\ninstance of acquisition of an additional class of business from\n\nanother small employer carrier.\n\nD. The Commissioner may approve the establishment of additional\n\nclasses of business upon application to the Commissioner and a\n\nfinding by the Commissioner that such action would enhance the\n\nefficiency and fairness of the small employer marketplace.\n\nE.
