Stat. tit. 36, § 36-6516","heading":"Renewability of health benefit plans - Election not to","body":"renew - Geographic service area.\n\nA. A health benefit plan subject to this act shall be renewable\n\nwith respect to all eligible employees and dependents, at the option\n\nof the small employer, except in any of the following cases:\n\n1. Nonpayment of the required premiums;\n\n2. Fraud or misrepresentation of the small employer or, with\n\nrespect to coverage of individual insureds, the insureds or their\n\nrepresentatives;\n\n3. Noncompliance with the carrier's minimum group participation\n\nrequirements;\n\n4. Noncompliance with the carrier's employer contribution\n\nrequirements;\n\n5. Repeated misuse of provider network provisions;\n\n6. The small employer carrier elects to nonrenew all of its\n\nhealth benefit plans issued to small employers in this state. In\n\nsuch a case the carrier shall:\n\na. provide advance notice of its decision under this\n\nparagraph to the Insurance Commissioner in each state\n\nin which it is licensed, and\n\nb. provide notice of the decision not to renew coverage\n\nto all affected small employers and to the\n\nCommissioner in each state in which an affected\n\ncovered individual is known to reside at least one\n\nhundred eighty (180) days prior to the nonrenewal of\n\nany health benefit plan by the carrier. Notice to the\n\nCommissioner under this subparagraph shall be provided\n\nat least three (3) working days prior to the notice to\n\nthe affected small employers; or\n\n7. The Commissioner finds that the continuation of the coverage\n\nwould:\n\na. not be in the best interests of the policyholders or\n\ncertificate holders, or\n\nb. impair the carrier's ability to meet its contractual\n\nobligations. In such instance the Commissioner may\n\nassist affected small employers in finding replacement\n\ncoverage.\n\nB. A small employer carrier that elects not to renew a health\n\nbenefit plan under paragraph 6 of subsection A of this section shall\n\nbe prohibited from writing new business in the small employer market\n\nin this state for a period of five (5) years from the date of notice\n\nto the Commissioner.\n\nC.
