Stat. tit. 36, § 36-6530.2","heading":"Definitions","body":"As used in the Oklahoma Individual Health Insurance Market\n\nStabilization Act:\n\n1. \"Agent\" means any person who is licensed to sell health\n\ninsurance in this state;\n\n2. \"Board\" means the Board of Directors of the Oklahoma\n\nIndividual Health Insurance Market Stabilization Program;\n\n3. \"Health insurance\" means any individual or group hospital or\n\nmedical-expense-incurred policy or health care benefits plan or\n\ncontract providing insurance against loss through illness or injury\n\nof the insured. The term does not include any policy governing\n\nshort-term accidents only, a fixed indemnity policy, a limited\n\nbenefit policy, a specified accident policy, a specified disease\n\npolicy, a Medicare supplement policy, a long-term care policy,\n\nmedical payment or personal injury coverage in a motor vehicle\n\npolicy, coverage issued as a supplement to liability insurance, a\n\ndisability policy or workers' compensation;\n\n4. \"High-risk pool\" means specially designated health insurance\n\nplans organized by federal or state entities, or a combination of\n\nfederal and state entities, to serve high-risk, high-cost or both\n\nhigh-risk and high-cost individuals who meet enrollment criteria and\n\ndo not have access to group insurance. They are organized as\n\nindependent entities governed by their own boards and administrators\n\nand supported by the state's department of insurance;\n\n5. \"Insurer\" means any individual, corporation, association,\n\npartnership, fraternal benefit society or any other entity engaged\n\nin the health insurance business, except insurance agents and\n\nbrokers. This term shall also include not-for-profit hospital\n\nservice and medical indemnity plans, health maintenance\n\norganizations, preferred provider organizations, prepaid health\n\nplans, the State and Education Employees Group Health Insurance\n\nPlan, stop-loss insurance plans and any reinsurer reinsuring health\n\ninsurance in this state, which shall be designated as engaged in the\n\nbusiness of insurance for the purposes of the Oklahoma Individual\n\nHealth Insurance Market Stabilization Act;\n\n6. \"Market\" means the individual health insurance market in\n\nOklahoma, wherein income-eligible individuals may receive federal\n\nfinancial assistance for the purchase of qualified health plans as\n\nprovided by Section 36B of Title 26 of the United States Code and\n\nSection 1301 of the federal Patient Protection and Affordable Care\n\nAct;\n\n7. \"Market stabilization activities\" means a high-risk pool,\n\nreinsurance, hybrid programs or any combination thereof authorized\n\nby this act;\n\n8. \"Plan\" means any of the comprehensive health insurance\n\nbenefit plans as approved by the Board of Directors of the Oklahoma\n\nIndividual Health Insurance Market Stabilization Program or\n\nqualified for participation in the market or by rule;\n\n9. \"Program\" means the Oklahoma Individual Health Insurance\n\nMarket Stabilization Program;\n\n10. \"Reinsurer\" means any insurer from whom any insurer\n\nproviding health insurance to Oklahomans procures insurance for\n\nitself with respect to all or part of the health insurance risk of\n\nthe person; and\n\n11. \"Reinsurance\" means the contract made between an entity\n\nproviding insurance coverage and a third party to protect the\n\ninsurer from losses. The contract provides for the third party to\n\npay for the loss sustained by the insurer when the insurer makes a\n\npayment on the original contract.
