If a utilization review entity requires prior authorization\n\nof a prescription drug, the utilization review entity shall make a\n\nprior authorization or adverse determination and notify the enrollee\n\nand the enrollee's health care provider of the prior authorization\n\nor adverse determination in accordance with the time frames set\n\nforth below:\n\n1. For purposes of approving prior authorization for urgent\n\nprescription drugs, within twenty-four (24) hours of obtaining all\n\nnecessary information to make the prior authorization or adverse\n\ndetermination; or\n\n2. For purposes of approving prior authorization for nonurgent\n\nprescription drugs, within four (4) business days of obtaining all\n\nnecessary information to make the prior authorization or adverse\n\ndetermination.\n\nFor purposes of this section, \"necessary information\" includes,\n\nbut is not limited to, the results of any face-to-face clinical\n\nevaluation or second opinion that may be required.\n\nB. For those health care providers that submit all necessary\n\ninformation through the utilization review entity's authorized prior\n\nauthorization system, prescription drugs are deemed authorized if a\n\nutilization review entity fails to comply with the deadlines set\n\nforth in this section.\n\nC.
