The Insurance Commissioner may, if the Commissioner\n\nfinds that any person or organization has violated the provisions of\n\nthis act, impose a penalty of not more than Five Thousand Dollars\n\n($5,000.00) for each such violation. Such penalties may be in\n\naddition to any other penalty provided by law.\n\n2. No penalty shall be imposed except upon written order of the\n\nCommissioner or the appointed independent hearing examiner, stating\n\nthe findings of the Commissioner or the appointed independent\n\nhearing examiner after the notice and opportunity for a hearing in\n\naccordance with Article II of the Administrative Procedures Act.\n\nB. 1. The Attorney General may, if the Attorney General finds\n\nthat a pharmacy benefits manager has violated the provisions of this\n\nact, impose a penalty of not more than Five Thousand Dollars\n\n($5,000.00) for each such violation. Such penalties may be in\n\naddition to any other penalty provided by law.\n\n2.
