A person may not maintain a cause of action under this act\n\nagainst a health insurance carrier, health maintenance organization,\n\nor other managed care entity unless the affected enrollee or the\n\nrepresentative of the enrollee, has exhausted any appeal and review\n\nprocess applicable under the utilization review requirements of the\n\nplan, has exhausted all applicable remedies specified in the\n\nOklahoma Managed Care External Review Act and gives written notice\n\nof the claim as provided in subsection B of this section.\n\nB. The notice required by subsection A of this section shall be\n\ndelivered or mailed to the health insurance carrier, health\n\nmaintenance organization, or managed care entity against whom the\n\naction will be brought at least thirty (30) days before the action\n\nis filed.\n\nC. If the enrollee or the representative of the enrollee has\n\nnot exhausted the appeal and review processes and gives notice as\n\nrequired by subsection A of this section before the statute of\n\nlimitations applicable to a claim against a managed care entity has\n\nexpired, the limitations period is tolled until thirty (30) days\n\nafter the date the enrollee or the representative of the enrollee\n\nhas exhausted the processes for appeal and review pursuant to\n\nsubsection A of this section.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0e75ae2101fe2061f52ce579de25fff9394bcd1d3126c4f0e7d2c06cc237614d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6593","next":"us-ok/okla.-stat.-tit.-36-36-6595"},"notice":"GroundRules: Original legal text.
