Stat. tit. 36, § 36-6656","heading":"Vehicle protection product warranty requirements -","body":"Incidental costs.\n\nA. Any vehicle protection product shall not be sold or offered\n\nfor sale in this state unless the warranty:\n\n1. States, “The obligations of the warrantor to the warranty\n\nholder are guaranteed under a warranty reimbursement insurance\n\npolicy”, if the warrantor elects to meet its financial\n\nresponsibility obligations under paragraph 1 of Section 6 of this\n\nact, or states, “The obligations of the warrantor under this\n\nwarranty are backed by the full faith and credit of the warrantor”,\n\nif the warrantor elects to meet its financial responsibility\n\nobligations under paragraph 2 of Section 6 of this act;\n\n2. States that in the event a warranty holder must make a claim\n\nagainst a party other than the warranty reimbursement insurance\n\npolicy issuer, the warranty holder is entitled to make a direct\n\nclaim against the insurer upon the failure of the warrantor to pay\n\nany claim or meet any obligation under the terms of the warranty\n\nwithin sixty (60) days after proof of loss has been filed with the\n\nwarrantor, if the warrantor elects to meet its financial\n\nresponsibility obligations under paragraph 1 of Section 6 of this\n\nact;\n\n3. States the name and address of the issuer of the warranty\n\nreimbursement insurance policy, and this information need not be\n\npreprinted on the warranty form, but may be added to or stamped on\n\nthe warranty, if the warrantor elects to meet its financial\n\nresponsibility obligations under paragraph 1 of Section 6 of this\n\nact;\n\n4. Identifies the warrantor, the seller, and the warranty\n\nholder;\n\n5. Sets forth the total product purchase price and the terms\n\nunder which it is to be paid; however, the purchase price is not\n\nrequired to be preprinted on the vehicle protection product warranty\n\nand may be negotiated with the consumer at the time of sale;\n\n6. Sets forth the procedure for making a claim, including a\n\ntelephone number;\n\n7. Specifies the payments or performance to be provided under\n\nthe warranty including payments for incidental costs, the manner of\n\ncalculation or determination of payments or performance, and any\n\nlimitations, exceptions or exclusions;\n\n8. Sets forth all of the obligations and duties of the warranty\n\nholder, such as the duty to protect against any further damage to\n\nthe vehicle, the obligation to notify the warrantor in advance of\n\nany repair, or other similar requirements, if any;\n\n9. Sets forth any terms, restrictions, or conditions governing\n\ntransferability and cancellation of the warranty, if any; and\n\n10. Contains a disclosure that reads substantially as follows:\n\n“This agreement is a product warranty and is not insurance.”\n\nB.
