Stat. tit. 36, § 36-6673","heading":"Sale of portable electronics insurance - Licensure","body":"exemptions.\n\nA. The employees and authorized representatives of vendors may\n\nsell or offer portable electronics insurance to customers and shall\n\nnot be subject to licensure as an insurance producer pursuant to\n\nSection 2 of this act if:\n\n1. The vendor obtains a limited lines license to authorize its\n\nemployees or authorized representatives to sell or offer portable\n\nelectronics insurance pursuant to Section 2 of this act;\n\n2. The insurer issuing the portable electronics insurance\n\neither directly supervises or appoints a supervising entity to\n\nsupervise the administration of the program including development of\n\na training program for employees and authorized representatives of\n\nthe vendors. The training required by this paragraph shall comply\n\nwith the following:\n\na. the training shall be delivered to employees and\n\nauthorized representatives of a vendor who is directly\n\nengaged in the activity of selling or offering\n\nportable electronics insurance,\n\nb. the training may be provided in electronic form. If\n\nconducted in an electronic form, the supervising\n\nentity shall implement a supplemental education\n\nprogram regarding portable electronics insurance that\n\nis conducted and overseen by licensed employees of the\n\nsupervising entity, and\n\nc. each employee and authorized representative shall\n\nreceive basic instruction about the portable\n\nelectronics insurance offered to customers and the\n\ndisclosures required pursuant to Section 3 of this\n\nact.\n\nNo employee or authorized representative of a vendor of portable\n\nelectronics shall advertise, represent or otherwise hold himself or\n\nherself out as a non limited lines licensed insurance producer.\n\nB. The charges for portable electronics insurance coverage may\n\nbe billed and collected by the vendor of portable electronics. Any\n\ncharge to the enrolled customer for coverage that is not included in\n\nthe cost associated with the purchase or lease of portable\n\nelectronics or related services shall be separately itemized on the\n\nenrolled customer’s bill. If the coverage is included with the\n\npurchase or lease of portable electronics or related services the\n\nvendor shall clearly and conspicuously disclose to the enrolled\n\ncustomer that the coverage is included with the purchase of the\n\nportable electronics or related services. Vendors billing and\n\ncollecting these charges shall not be required to maintain the funds\n\nin a segregated account provided that the vendor is authorized by\n\nthe insurer to hold the funds in an alternative manner and to remit\n\nthe amounts to the supervising entity within sixty (60) days of\n\nreceipt. All funds received by a vendor from an enrolled customer\n\nfor the sale of portable electronics insurance shall be considered\n\nfunds held in trust by the vendor in a fiduciary capacity for the\n\nbenefit of the insurer.
