Stat. tit. 36, § 36-6712","heading":"Definitions","body":"As used in the Travel Insurance Act, the term:\n\n1. “Aggregator site” means a website that provides access to\n\ninformation regarding insurance products from more than one insurer,\n\nincluding product and insurer information, for use in comparison\n\nshopping;\n\n2. “Blanket travel insurance” means a policy of travel\n\ninsurance issued to any eligible group providing coverage for\n\nspecific classes of persons defined in the policy, with coverage\n\nprovided to all members of the eligible group without a separate\n\ncharge to individual members of the eligible group;\n\n3. “Cancellation fee waiver” means a contractual agreement\n\nbetween a supplier of travel services and its customer to waive some\n\nor all of the nonrefundable cancellation fee provisions of the\n\nsupplier’s underlying travel contract, with or without regard to the\n\nreason for the cancellation or form of reimbursement. A\n\ncancellation fee waiver is not insurance;\n\n4. “Commissioner” means the Oklahoma Insurance Commissioner;\n\n5. “Eligible group” means, solely for the purposes of travel\n\ninsurance, two or more persons who are engaged in a common\n\nenterprise, or have an economic, educational or social affinity or\n\nrelationship including, but not limited to, any of the following:\n\na. any entity engaged in the business of providing travel\n\nor travel services including, but not limited to, tour\n\noperators, lodging providers, vacation property\n\nowners, hotels and resorts, travel clubs, travel\n\nagencies, property managers, cultural exchange\n\nprograms and common carriers or the operator, owner or\n\nlessor of a means of transportation of passengers\n\nincluding, but not limited to, airlines, cruise lines,\n\nrailroads, steamship companies and public bus\n\ncarriers, wherein with regard to any particular travel\n\nor type of travel or travelers, all members or\n\ncustomers of the group must have a common exposure to\n\nrisk attendant to such travel,\n\nb. any college, school or other institution of learning\n\ncovering students, teachers, employees or volunteers,\n\nc. any employer covering any group of employees,\n\nvolunteers, contractors, board of directors,\n\ndependents or guests,\n\nd. any sports team, camp or sponsor thereof covering\n\nparticipants, members, campers, employees, officials,\n\nsupervisors or volunteers,\n\ne. any religious, charitable, recreational, educational\n\nor civic organization or branch thereof covering any\n\ngroup of members, participants or volunteers,\n\nf. any financial institution or financial institution\n\nvendor, or parent holding company, trustee or agent of\n\nor designated by one or more financial institutions or\n\nfinancial institution vendors, including\n\naccountholders, credit card holders, debtors,\n\nguarantors or purchasers,\n\ng. any incorporated or unincorporated association,\n\nincluding labor unions, having a common interest,\n\nconstitution and bylaws and organized and maintained\n\nin good faith for purposes other than obtaining\n\ninsurance for members or participants of such\n\nassociation covering its members,\n\nh. any trust or the trustees of a fund established,\n\ncreated or maintained for the benefit of and covering\n\nmembers, employees or customers, subject to the\n\npermission of the Insurance Commissioner, the use of a\n\ntrust and the state’s premium tax provisions in\n\nSection 6714 of this title of one or more associations\n\nmeeting the above requirements of this paragraph,\n\ni. any entertainment production company covering any\n\ngroup of participants, volunteers, audience members,\n\ncontestants or workers,\n\nj. any volunteer fire department, ambulance, rescue,\n\npolice, court or any first aid, civil defense or other\n\nsuch volunteer group,\n\nk. preschools, daycare institutions for children or\n\nadults and senior citizen clubs,\n\nl. any automobile or truck rental or leasing company\n\ncovering a group of individuals who may become\n\nrenters, lessees or passengers defined by their travel\ntment, ambulance, rescue,\n\npolice, court or any first aid, civil defense or other\n\nsuch volunteer group,\n\nk. preschools, daycare institutions for children or\n\nadults and senior citizen clubs,\n\nl. any automobile or truck rental or leasing company\n\ncovering a group of individuals who may become\n\nrenters, lessees or passengers defined by their travel\n\nstatus on the rented or leased vehicles. The common\n\ncarrier, the operator, owner or lessor of a means of\n\ntransportation or the automobile or truck rental or\n\nleasing company is the policyholder under a policy to\n\nwhich this paragraph applies, or\n\nm. any other group where the Commissioner has determined\n\nthat the members are engaged in a common enterprise,\n\nor have an economic, educational or social affinity or\n\nrelationship, and that issuance of the policy would\n\nnot be contrary to the public interest;\n\n6. “Fulfillment materials” means documentation sent to the\n\npurchaser of a travel protection plan confirming the purchase and\n\nproviding the coverage and assistance details of the travel\n\nprotection plan;\n\n7. “Group travel insurance” means travel insurance issued to\n\nany eligible group;\n\n8. “Limited lines travel insurance producer” means a:\n\na. licensed managing general agent or third-party\n\nadministrator,\n\nb. licensed insurance producer, including a limited lines\n\nproducer, or\n\nc. travel administrator;\n\n9. “Offer and disseminate” means providing general information,\n\nincluding a description of the coverage and price, as well as\n\nprocessing the application and collecting premiums;\n\n10. “Travel administrator” means a person who directly or\n\nindirectly underwrites, collects charges, collateral or premiums\n\nfrom or adjusts or settles claims on residents of this state, in\n\nconnection with travel insurance, except that a person shall not be\n\nconsidered a travel administrator if he or she is:\n\na. a person working for a travel administrator whose\n\nactivities are subject to the supervision and control\n\nof the travel administrator,\n\nb. an insurance producer selling insurance or engaged in\n\nadministrative and claims-related activities within\n\nthe scope of the license of the producer,\n\nc. a travel retailer offering and disseminating travel\n\ninsurance and registered under the license of a\n\nlimited lines travel insurance producer in accordance\n\nwith the Travel Insurance Act,\n\nd. an individual adjusting or settling claims in the\n\nnormal course of practice or employment of the\n\nindividual as an attorney-at-law and who does not\n\ncollect charges or premiums in connection with\n\ninsurance coverage, or\n\ne. a business entity that is affiliated with a licensed\n\ninsurer while acting as a travel administrator for the\n\ndirect and assumed insurance business of an affiliated\n\ninsurer;\n\n11. “Travel assistance services” means noninsurance services\n\nfor which the consumer is not indemnified based on a fortuitous\n\nevent, and where providing the services does not result in transfer\n\nor shifting of risk that would constitute the business of insurance.\n\nTravel assistance services include, but are not limited to: security\n\nadvisories; destination information; vaccination and immunization\n\ninformation services; travel reservation services; entertainment;\n\nactivity and event planning; translation assistance; emergency\n\nmessaging; international legal and medical referrals; medical case\n\nmonitoring; coordination of transportation arrangements; emergency\n\ncash transfer assistance; medical prescription replacement\n\nassistance; passport and travel document replacement assistance;\n\nlost luggage assistance; concierge services; and any other service\n\nthat is furnished in connection with planned travel. Travel\n\nassistance services are not insurance and not related to insurance;\n\n12. “Travel insurance” means insurance coverage for personal\n\nrisks incident to planned travel, including:\ncal prescription replacement\n\nassistance; passport and travel document replacement assistance;\n\nlost luggage assistance; concierge services; and any other service\n\nthat is furnished in connection with planned travel. Travel\n\nassistance services are not insurance and not related to insurance;\n\n12. “Travel insurance” means insurance coverage for personal\n\nrisks incident to planned travel, including:\n\na. interruption or cancellation of trip or event,\n\nb. loss of baggage or personal effects,\n\nc. damages to accommodations or rental vehicles,\n\nd. sickness, accident, disability or death occurring\n\nduring travel,\n\ne. emergency evacuation,\n\nf. repatriation of remains, or\n\ng. any other contractual obligations to indemnify or pay\n\na specified amount to the traveler upon determinable\n\ncontingencies related to travel as approved by the\n\nCommissioner.\n\nTravel insurance shall not include major medical plans that provide\n\ncomprehensive medical protection for travelers with trips lasting\n\nlonger than six (6) months including, but not limited to, those\n\nworking or residing overseas as an expatriate, or any other product\n\nthat requires a specific insurance producer license;\n\n13. “Travel protection plans” means plans that provide one or\n\nmore of the following: travel insurance, travel assistance services\n\nand cancellation fee waivers; and\n\n14. “Travel retailer” means a business entity that makes,\n\narranges or offers planned travel and may offer and disseminate\n\ntravel insurance as a service to its customers on behalf of and\n\nunder the direction of a limited lines travel insurance producer.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8d27ec95a73be365c30c395ccd26028e104c637b20d54b4c5fe42889d16c8d1f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6711","next":"us-ok/okla.-stat.-tit.-36-36-6713"},"notice":"GroundRules: Original legal text.
