The Insurance Commissioner may issue a limited lines travel\n\ninsurance producer license to an individual or business entity that\n\nhas filed with the Commissioner an application for such license in a\n\nform and manner prescribed by the Commissioner. The limited lines\n\ntravel insurance producer shall be licensed to sell, solicit or\n\nnegotiate travel insurance through a licensed insurer. No person\n\nmay act as a limited lines travel insurance producer or travel\n\ninsurance retailer unless properly licensed or registered,\n\nrespectively.\n\nB. A travel retailer may offer and disseminate travel insurance\n\nunder a limited lines travel insurance producer business entity\n\nlicense only if:\n\n1. The limited lines travel insurance producer or travel\n\nretailer provides to purchasers of travel insurance:\n\na. a description of the material terms or the actual\n\nmaterial terms of the insurance coverage,\n\nb. a description of the process for filing a claim,\n\nc. a description of the review or cancellation process\n\nfor the travel insurance policy, and\n\nd. the identity and contact information of the insurer\n\nand limited lines travel insurance producer;\n\n2. At the time of licensure, the limited lines travel insurance\n\nproducer shall establish and maintain a register on a form\n\nprescribed by the Commissioner of each travel retailer that offers\n\ntravel insurance on behalf of the limited lines travel insurance.\n\nThe register shall be maintained and updated by the limited lines\n\ntravel insurance producer and shall include the name, address and\n\ncontact information of the travel retailer and an officer or person\n\nwho directs or controls the operations of the travel retailer and\n\nthe federal tax identification number of the travel retailer. The\n\nlimited lines travel insurance producer shall submit the register to\n\nthe Insurance Department upon reasonable request. The limited lines\n\ntravel insurance producer shall also certify that the registered\n\ntravel retailer complies with 18 U.S.C., Section 1033. The grounds\n\nfor the suspension, revocation and the penalties applicable to\n\nresident insurance producers, pursuant to Section 1435.13 of this\n\ntitle, shall be applicable to the limited lines travel insurance\n\nproducers and travel retailers;\n\n3. The limited lines travel insurance producer has designated\n\none of its employees, a designated responsible producer, who is a\n\nlicensed individual producer as the person responsible for the\n\ncompliance with the travel insurance laws and regulations applicable\n\nto the limited lines travel insurance producer and its registrants;\n\n4. The designated responsible producer, president, secretary,\n\ntreasurer and any other officer or person who directs or controls\n\nthe limited lines travel insurance producer’s insurance operations\n\ncomply with the fingerprinting requirements applicable to insurance\n\nproducers in the resident state of the limited lines travel\n\ninsurance producer;\n\n5. The limited lines travel insurance producer has paid all\n\napplicable insurance producer licensing fees as set forth in Section\n\n1435.23 of this title; and\n\n6. The limited lines travel insurance producer requires each\n\nemployee and authorized representative of the travel retailer whose\n\nduties include offering and disseminating travel insurance to\n\nreceive a program of instruction or training, which is subject to\n\nthe discretion of the Commissioner to review and approve. The\n\ntraining material shall, at a minimum, contain adequate instructions\n\non the types of insurance offered, ethical sales practices and\n\nrequired disclosures to prospective customers.\n\nC. Any travel retailer offering or disseminating travel\n\ninsurance shall make available to prospective purchasers brochures\n\nor other written materials that have been approved by the travel\n\ninsurer. Such materials shall include information which, at a\n\nminimum:\n\n1. Provides the identity and contact information of the insurer\ncal sales practices and\n\nrequired disclosures to prospective customers.\n\nC. Any travel retailer offering or disseminating travel\n\ninsurance shall make available to prospective purchasers brochures\n\nor other written materials that have been approved by the travel\n\ninsurer. Such materials shall include information which, at a\n\nminimum:\n\n1. Provides the identity and contact information of the insurer\n\nand the limited lines travel insurance producer;\n\n2. Explains that the purchase of travel insurance is not\n\nrequired in order to purchase any other product or service from the\n\ntravel retailer; and\n\n3. Explains that an unlicensed travel retailer is permitted to\n\nprovide only general information about the insurance offered by the\n\ntravel retailer, including a description of the coverage and price,\n\nbut is not qualified or authorized to answer technical questions\n\nabout the terms and conditions of the insurance offered by the\n\ntravel retailer or to evaluate the adequacy of the customer’s\n\nexisting insurance coverage.\n\nD. A travel retailer employee or authorized representative who\n\nis not licensed as an insurance producer may not:\n\n1. Evaluate or interpret the technical terms, benefits and\n\nconditions of the offered travel insurance coverage;\n\n2. Evaluate or provide advice concerning existing insurance\n\ncoverage for a prospective purchaser; or\n\n3. Hold himself, herself or itself out as a licensed insurer,\n\nlicensed producer or insurance expert.\n\nE. Notwithstanding any other provision in law, a travel\n\nretailer whose insurance-related activities, and those of its\n\nemployees and authorized representatives, are limited to offering\n\nand disseminating travel insurance on behalf of and under the\n\ndirection of a limited lines travel insurance producer meeting the\n\nconditions stated in the Travel Insurance Act, is authorized to\n\nreceive related compensation, upon registration by the limited lines\n\ntravel insurance producer as described in paragraph 2 of subsection\n\nB of this section.\n\nF. As the insurer designee, the limited lines travel insurance\n\nproducer is responsible for the acts of the travel retailer and\n\nshall use reasonable means to ensure compliance by the travel\n\nretailer with the Travel Insurance Act.\n\nG. Any person licensed as an insurance producer with a line of\n\nauthority set forth in paragraphs 1 through 4, 6 and 7 of subsection\n\nA of Section 1435.8 of this title is authorized to sell, solicit and\n\nnegotiate travel insurance.
