Stat. tit. 36, § 36-6752","heading":"Definitions","body":"As used in the Oklahoma Home Service Contract Act:\n\n1. “Administrator” means the person who is responsible for the\n\nadministration of home service contracts or the home service\n\ncontracts plan, who may promote the contract under their own private\n\nlabel or brand as long as the provider is clearly identified on the\n\ncontract, or who is responsible for any submission required by the\n\nOklahoma Home Service Contract Act;\n\n2. “Commissioner” means the Insurance Commissioner;\n\n3. “Consumer” means a natural person who buys other than for\n\npurposes of resale any tangible personal property that is\n\ndistributed in commerce and that is normally used for personal,\n\nfamily or household purposes and not for business or research\n\npurposes;\n\n4. “Maintenance agreement” means a contract of limited duration\n\nthat provides for scheduled maintenance only and does not include\n\nrepair or replacement;\n\n5. “Person” means an individual, partnership, corporation,\n\nincorporated or unincorporated association, joint stock company,\n\nreciprocal, syndicate or any similar entity or combination of\n\nentities acting in concert;\n\n6. “Provider” means the person who is the contractually named\n\nobligor to the home service contract holder under the terms of the\n\nservice contract;\n\n7. “Provider fee” means the consideration paid for a home\n\nservice contract;\n\n8. “Reimbursement insurance policy” means a policy of insurance\n\nissued to a provider to either provide reimbursement to the provider\n\nunder the terms of the insured home service contracts issued or sold\n\nby the provider or, in the event of the provider’s nonperformance,\n\nto pay on behalf of the provider all covered contractual obligations\n\nincurred by the provider under the terms of the insured home service\n\ncontracts issued or sold by the provider;\n\n9. “Home service contract” or “home warranty” means a contract\n\nor agreement for a separately stated consideration for a specific\n\nduration to perform the service, repair, replacement or maintenance\n\nof property or indemnification for service, repair, replacement or\n\nmaintenance, for the operational or structural failure of any\n\nresidential property due to a defect in materials, workmanship,\n\ninherent defect or normal wear and tear, with or without additional\n\nprovisions for incidental payment or indemnity under limited\n\ncircumstances. Home service contracts may provide for the service,\n\nrepair, replacement, or maintenance of property for damage resulting\n\nfrom power surges or interruption and accidental damage from\n\nhandling and may provide for leak or repair coverage to house\n\nroofing systems. Home service contracts and home warranties are not\n\ninsurance in this state or otherwise regulated under the Insurance\n\nCode;\n\n10. “Service contract holder” or “contract holder” means a\n\nperson who is the purchaser or holder of a home service contract;\n\nand\n\n11. “Warranty” means a warranty made solely by the\n\nmanufacturer, importer or seller of property or services including\n\nbuilders on new home construction, without consideration, that is\n\nnot negotiated or separated from the sale of the product and is\n\nincidental to the sale of the product, that guarantees indemnity for\n\ndefective parts, mechanical or electrical breakdown, labor or other\n\nremedial measures, such as repair or replacement of the property or\n\nrepetition of services.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"191ae2538e4ec89cec76a13a6c5f8bd780b9c2bdb68b14367c3dbe338e9ba09a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6751","next":"us-ok/okla.-stat.-tit.-36-36-6753"},"notice":"GroundRules: Original legal text.
