Service contracts marketed, sold, offered for sale, issued,\n\nmade, proposed to be made, or administered in this state shall be\n\nwritten, printed, or typed in clear, understandable language that is\n\neasy to read, and shall disclose the requirements set forth in this\n\nsection, as applicable. Each service contract provider shall, upon\n\ninitial registration and at renewal of its registration, file a copy\n\nof each of its current contracts issued in this state for\n\ninformational purposes. The provider shall update a filing any time\n\na change is made to the service contract that materially affects the\n\nrights or obligations of a contract holder or upon written request\n\nby the Department.\n\nB. Service contracts insured under an insurance policy pursuant\n\nto paragraph 3 of subsection C of Section 6753 of this title shall\n\ncontain a statement in substantially the following form:\n\n\"Obligations of the provider under this service contract are insured\n\nunder a service contract reimbursement insurance policy.\" The\n\nservice contract shall also state the name and address of the\n\ninsurer.\n\nC. Service contracts not insured under an insurance policy\n\npursuant to paragraph 3 of subsection C of Section 6753 of this\n\ntitle shall contain a statement in substantially the following form:\n\n\"Obligations of the provider under this service contract are backed\n\nby the full faith and credit of the provider.\"\n\nD. Service contracts shall state the name and address of the\n\nprovider, and shall identify any administrator if different from the\n\nprovider, the service contract seller, and the service contract\n\nholder to the extent that the name of the service contract holder\n\nhas been furnished by the service contract holder. The identities\n\nof such parties are not required to be preprinted on the service\n\ncontract and may be added to the service contract at the time of\n\nsale.\n\nE. Service contracts shall state the total purchase price and\n\nthe terms under which service contract is sold. The purchase price\n\nis not required to be preprinted on the service contract and may be\n\nnegotiated at the time of sale with the service contract holder.\n\nF. Service contracts shall state the existence of any trade\n\nservice fee, if applicable.\n\nG. Service contracts shall specify the merchandise and services\n\nto be provided and any limitations, exceptions, or exclusions.\n\nH. Service contracts shall state any restrictions governing the\n\ntransferability of the service contract, if applicable.\n\nI. Service contracts shall state the terms, restrictions or\n\nconditions governing cancellation of the service contract.\n\nJ. Service contracts shall set forth all of the obligations and\n\nduties of the service contract holder, such as the duty to protect\n\nagainst any further damage and any requirement to follow the owner's\n\nmanual.\n\nK. Service contracts shall state whether or not the service\n\ncontract provides for or excludes consequential damages or\n\npreexisting conditions, if applicable. Service contracts may, but\n\nare not required to, cover damage resulting from rust, corrosion or\n\ndamage caused by a noncovered part or system.\n\nL. If prior approval of repair work is required, a service\n\ncontract shall state the procedure for obtaining prior approval and\n\nfor making a claim, including a toll-free telephone number for claim\n\nservice and a procedure for obtaining emergency repairs performed\n\noutside of normal business hours.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2b93158cda88a3c670d51cea039ce5584a87fee6ca26f7fe7b67163c972a69c3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6753","next":"us-ok/okla.-stat.-tit.-36-36-6755"},"notice":"GroundRules: Original legal text.
