Any documents, materials, or other information in the\n\ncontrol or possession of the Insurance Department that are furnished\n\nby a licensee or an employee or agent thereof acting on behalf of a\n\nlicensee pursuant to the provisions of Section 4 and Section 6 of\n\nthis act or that are obtained by the Insurance Commissioner in an\n\ninvestigation or examination pursuant to Section 7 of this act shall\n\nbe confidential by law and privileged, shall not be subject to the\n\nOklahoma Open Records Act, shall not be subject to subpoena, and\n\nshall not be subject to discovery or admissible in evidence in any\n\nprivate civil action. However, the Commissioner is authorized to\n\nuse the documents, materials, or other information in the\n\nfurtherance of any regulatory or legal action brought as a part of\n\nthe Commissioner’s duties. The Commissioner shall not otherwise\n\nmake the documents, materials, or other information public without\n\nthe prior written consent of the licensee.\n\nB. Neither the Commissioner nor any person who received\n\ndocuments, materials, or other information while acting under the\n\nauthority of the Commissioner shall be permitted or required to\n\ntestify in any private civil action concerning any confidential\n\ndocuments, materials, or information subject to subsection A of this\n\nsection.\n\nC. In order to assist in the performance of the duties of the\n\nCommissioner under this act, the Commissioner:\n\n1. May share documents, materials, or other information\n\nincluding the confidential and privileged documents, materials, or\n\ninformation subject to subsection A of this section, with other\n\nstate, federal, and international regulatory agencies, with the\n\nNational Association of Insurance Commissioners and its affiliates\n\nor subsidiaries and with state, federal, and international law\n\nenforcement authorities; provided, that the recipient agrees in\n\nwriting to maintain the confidentiality and privileged status of the\n\ndocument, material, or other information;\n\n2. May receive documents, materials, or information including\n\notherwise confidential and privileged documents, materials, or\n\ninformation, from the National Association of Insurance\n\nCommissioners, its affiliates or subsidiaries, and from regulatory\n\nand law enforcement officials of other foreign or domestic\n\njurisdictions, and shall maintain as confidential or privileged any\n\ndocument, material, or information received with notice or the\n\nunderstanding that it is confidential or privileged under the laws\n\nof the jurisdiction that is the source of the document, material, or\n\ninformation;\n\n3. May share documents, materials, or other information subject\n\nto subsection A of this section, with a third-party consultant or\n\nvendor; provided, the consultant agrees in writing to maintain the\n\nconfidentiality and privileged status of the document, material, or\n\nother information; and\n\n4. May enter into agreements governing sharing and use of\n\ninformation consistent with this subsection.\n\nD. No waiver of any applicable privilege or claim of\n\nconfidentiality in the documents, materials, or information shall\n\noccur as a result of disclosure to the Insurance Commissioner under\n\nthis section or as a result of sharing as authorized in subsection C\n\nof this section.\n\nE. Nothing in this act shall prohibit the Commissioner from\n\nreleasing final, adjudicated actions that are open to public\n\ninspection pursuant to the Oklahoma Open Records Act, to a database\n\nor other clearinghouse service maintained by the National\n\nAssociation of Insurance Commissioners, its affiliates, or\n\nsubsidiaries.\n\nF. Documents, materials, or other information in the possession\n\nor control of the National Association of Insurance Commissioners or\n\na third-party consultant or vendor pursuant to this act shall not be\n\nconstrued to be public information, shall not be subject to the\nother clearinghouse service maintained by the National\n\nAssociation of Insurance Commissioners, its affiliates, or\n\nsubsidiaries.\n\nF.
