Stat. tit. 36, § 36-6802v2","heading":"Definitions","body":"As used in the Oklahoma Telemedicine Act:\n\n1. \"Distant site\" means a site at which a health care\n\nprofessional licensed to practice in this state is located while\n\nproviding health care services by means of telemedicine;\n\n2. a. \"Health benefits plan\" means any plan or arrangement\n\nthat:\n\n(1) provides benefits for medical or surgical\n\nexpenses incurred as a result of a health\n\ncondition, accident or illness, and\n\n(2) is offered by any insurance company, group\n\nhospital service corporation or health\n\nmaintenance organization that delivers or issues\n\nfor delivery an individual, group, blanket or\n\nfranchise insurance policy or insurance\n\nagreement, a group hospital service contract or\n\nan evidence of coverage, or, to the extent\n\npermitted by the Employee Retirement Income\n\nSecurity Act of 1974, 29 U.S.C., Section 1001 et\n\nseq., by a multiple employer welfare arrangement\n\nas defined in Section 3 of the Employee\n\nRetirement Income Security Act of 1974, or any\n\nother analogous benefit arrangement, whether the\n\npayment is fixed or by indemnity,\n\nb. Health benefits plan shall not include:\n\n(1) a plan that provides coverage:\n\n(a) only for a specified disease or diseases or\n\nunder an individual limited benefit policy,\n\n(b) only for accidental death or dismemberment,\n\n(c) only for dental or vision care,\n\n(d) for a hospital confinement indemnity policy,\n\n(e) for disability income insurance or a\n\ncombination of accident-only and disability\n\nincome insurance, or\n\n(f) as a supplement to liability insurance,\n\n(2) a Medicare supplemental policy as defined by\n\nSection 1882(g)(1) of the Social Security Act (42\n\nU.S.C., Section 1395ss),\n\n(3) workers' compensation insurance coverage,\n\n(4) medical payment insurance issued as part of a\n\nmotor vehicle insurance policy,\n\n(5) a long-term care policy including a nursing home\n\nfixed indemnity policy, unless a determination is\n\nmade that the policy provides benefit coverage so\n\ncomprehensive that the policy meets the\n\ndefinition of a health benefits plan,\n\n(6) short-term health insurance issued on a\n\nnonrenewable basis with a duration of six (6)\n\nmonths or less, or\n\n(7) a plan offered by the Employees Group Insurance\n\nDivision of the Office of Management and\n\nEnterprise Services;\n\n3. \"Health care professional\" means a physician or other health\n\ncare practitioner licensed, accredited or certified to perform\n\nspecified health care services consistent with state law;\n\n4. \"Insurer\" means any entity providing an accident and health\n\ninsurance policy in this state including, but not limited to, a\n\nlicensed insurance company, a not-for-profit hospital service and\n\nmedical indemnity corporation, a fraternal benefit society, a\n\nmultiple employer welfare arrangement or any other entity subject to\n\nregulation by the Insurance Commissioner;\n\n5. \"Originating site\" means a site at which a patient is\n\nlocated at the time health care services are provided to him or her\n\nby means of telemedicine, which may include, but shall not be\n\nrestricted to, a patient's home, workplace or school;\n\n6. \"Remote patient monitoring services\" means the delivery of\n\nhome health services using telecommunications technology to enhance\n\nthe delivery of home health care including monitoring of clinical\n\npatient data such as weight, blood pressure, pulse, pulse oximetry,\n\nblood glucose and other condition-specific data, medication\n\nadherence monitoring and interactive video conferencing with or\n\nwithout digital image upload;\n\n7. \"Store and forward transfer\" means the transmission of a\n\npatient's medical information either to or from an originating site\n\nor to or from the health care professional at the distant site, but\n\ndoes not require the patient being present nor must it be in real\n\ntime; and\n\n8. \"Telemedicine\" or \"telehealth\" means technology-enabled\n\nhealth and care management and delivery systems that extend capacity\ntore and forward transfer\" means the transmission of a\n\npatient's medical information either to or from an originating site\n\nor to or from the health care professional at the distant site, but\n\ndoes not require the patient being present nor must it be in real\n\ntime; and\n\n8. \"Telemedicine\" or \"telehealth\" means technology-enabled\n\nhealth and care management and delivery systems that extend capacity\n\nand access, which includes:\n\na. synchronous mechanisms, which may include live\n\naudiovisual interaction between a patient and a health\n\ncare professional or real-time provider-to-provider\n\nconsultation through live interactive audiovisual\n\nmeans,\n\nb. asynchronous mechanisms, which include store and\n\nforward transfers, online exchange of health\n\ninformation between a patient and a health care\n\nprofessional and online exchange of health information\n\nbetween health care professionals, but shall not\n\ninclude the use of automated text messages or\n\nautomated mobile applications that serve as the sole\n\ninteraction between a patient and a health care\n\nprofessional,\n\nc. remote patient monitoring, and\n\nd. other electronic means that support clinical health\n\ncare, professional consultation, patient and\n\nprofessional health-related education, public health\n\nand health administration.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"731445e08fe4c5d249a25b0753ae096bd0d5e864467734c7a97607e6a7207214","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6802v1","next":"us-ok/okla.-stat.-tit.-36-36-6803"},"notice":"GroundRules: Original legal text.
