Sections 6810 through 6820 of this title shall be known and\n\nmay be cited as the “Medical Professional Liability Insurance Closed\n\nClaim Reports Act”.\n\nB. The Medical Professional Liability Insurance Closed Claim\n\nReports Act shall apply to all medical professional liability claims\n\nin this state, regardless of whether or how the claims are covered\n\nby medical professional liability insurance.\n\nC. As used in the Medical Professional Liability Insurance\n\nClosed Claim Reports Act:\n\n1. “Claim” means:\n\na. a demand for monetary damages for injury or death\n\ncaused by medical malpractice, or\n\nb. a voluntary indemnity payment for injury or death\n\ncaused by medical malpractice;\n\n2. “Claimant” means a person, including an estate of a\n\ndecedent, who is seeking or has sought monetary damages for injury\n\nor death caused by medical malpractice;\n\n3. “Closed claim” means a claim that has been settled or\n\notherwise disposed of by the insuring entity, self-insurer,\n\nfacility, or provider. A claim may be closed with or without an\n\nindemnity payment to a claimant;\n\n4. “Commissioner” means the Insurance Commissioner;\n\n5. “Companion claims” means separate claims involving the same\n\nincident of medical malpractice made against other providers or\n\nfacilities;\n\n6. “Economic damages” means objectively verifiable monetary\n\nlosses, including medical expenses, loss of earnings, burial costs,\n\nloss of use of property, cost of replacement or repair, cost of\n\nobtaining substitute domestic services, and loss of business or\n\nemployment opportunities;\n\n7. “Health care facility” or “facility” means a clinic,\n\ndiagnostic center, hospital, laboratory, mental health center,\n\nnursing home, office, surgical facility, treatment facility, or\n\nsimilar place where a health care provider provides health care to\n\npatients;\n\n8. “Health care provider” or “provider” means:\n\na. a person licensed to provide health care or related\n\nservices, including an acupuncturist, doctor of\n\nmedicine or osteopathy, a dentist, a nurse, an\n\noptometrist, a podiatric physician and surgeon, a\n\nchiropractor, a physical therapist, a psychologist, a\n\npharmacist, an optician, a physician’s assistant, a\n\nmidwife, an osteopathic physician’s assistant, a nurse\n\npractitioner, or a physician’s trained mobile\n\nintensive care paramedic. If the person is deceased,\n\nthis includes the estate or personal representative of\n\nthe person, or\n\nb. an employee or agent of a person described in\n\nsubparagraph a of this paragraph, acting in the course\n\nand scope of the employment of the employee. If the\n\nemployee or agent is deceased, this includes the\n\nestate or personal representative of the employee;\n\n9. “Insuring entity” means:\n\na. an authorized insurer,\n\nb. a captive insurer,\n\nc. a joint underwriting association,\n\nd. a patient compensation fund,\n\ne. a risk retention group, or\n\nf. an unauthorized insurer that provides surplus lines\n\ncoverage;\n\n10. “Medical malpractice” means an actual or alleged negligent\n\nact, error, or omission in providing or failing to provide health\n\ncare services;\n\n11. “Noneconomic damages” means subjective, nonmonetary losses,\n\nincluding pain, suffering, inconvenience, mental anguish, disability\n\nor disfigurement incurred by the injured party, emotional distress,\n\nloss of society and companionship, loss of consortium, humiliation\n\nand injury to reputation, and destruction of the parent-child\n\nrelationship; and\n\n12. “Self-insurer” means any health care provider, facility, or\n\nother individual or entity that assumes operational or financial\n\nrisk for claims of medical professional liability.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b92635e8f9a6d9acabe6f25ba4980ba9b9f93a644e29687fb46a216db6c34f58","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6803","next":"us-ok/okla.-stat.-tit.-36-36-6811"},"notice":"GroundRules: Original legal text.
