Stat. tit. 36, § 36-6812.1","heading":"Required information, format, and coding protocol in","body":"reports.\n\nReports required under Section 6811 of this title must contain\n\nthe following information in a format and coding protocol prescribed\n\nby the Insurance Commissioner. To the greatest extent possible\n\nwhile still fulfilling the purposes of the Medical Professional\n\nLiability Insurance Closed Claim Reports Act, the format and coding\n\nprotocol shall be consistent with the format and coding protocol for\n\ndata reported to the National Practitioner Data Bank.\n\n1. Claim and incident identifiers, including:\n\na. a claim identifier assigned to the claim by the\n\ninsuring entity, self-insurer, facility, or provider,\n\nand\n\nb. an incident identifier if companion claims have been\n\nmade by a claimant;\n\n2. The policy limits of the medical professional liability\n\ninsurance policy covering the claim;\n\n3. The medical specialty of the provider who was primarily\n\nresponsible for the medical malpractice incident that led to the\n\nclaim;\n\n4. The type of health care facility where the medical\n\nmalpractice incident occurred;\n\n5. The primary location within a facility where the medical\n\nmalpractice incident occurred;\n\n6. The geographic location, by city and county, where the\n\nmedical malpractice incident occurred;\n\n7. The sex and age of the injured person on the incident date;\n\n8. The severity of malpractice injury using the National\n\nPractitioner Data Bank severity scale;\n\n9. The dates of:\n\na. the earliest act or omission by the defendant that was\n\nthe proximate cause of the claim,\n\nb. notice to the insuring entity, self-insurer, facility,\n\nor provider,\n\nc. suit, if a suit was filed,\n\nd. final indemnity payment, if any, and\n\ne. final action by the insuring entity, self-insurer,\n\nfacility, or provider to close the claim;\n\n10. Settlement information that identifies the timing and final\n\nmethod of claim disposition, including:\n\na. claims settled by the parties,\n\nb. claims disposed of by a court, including the date\n\ndisposed,\n\nc. claims disposed of by alternative dispute resolution,\n\nsuch as arbitration, mediation, private trial, and\n\nother common dispute resolution methods, and\n\nd. whether the settlement occurred before or after trial,\n\nif a trial occurred;\n\n11. Specific information about the indemnity payments and\n\ndefense and cost-containment expenses, including:\n\na. for claims disposed of by a court that result in a\n\nverdict or judgment that itemizes damages:\n\n(1) the indemnity payment made on behalf of the\n\ndefendant,\n\n(2) economic damages,\n\n(3) noneconomic damages,\n\n(4) punitive damages, if applicable, and\n\n(5) defense and cost-containment expenses, including\n\ncourt costs, attorney fees, and costs of expert\n\nwitnesses, and\n\nb. for claims that do not result in a verdict or judgment\n\nthat itemizes damages:\n\n(1) the total amount of the settlement on behalf of\n\nthe defendant,\n\n(2) the insuring entity’s or self-insurer’s best\n\nestimate of economic damages included in the\n\nsettlement,\n\n(3) the insuring entity’s or self-insurer’s best\n\nestimate of noneconomic damages included in the\n\nsettlement, and\n\n(4) defense and cost-containment expenses, including\n\ncourt costs, attorney fees, and costs of expert\n\nwitnesses;\n\n12. The reason for the medical professional liability claim.\n\nThe reporting entity must use the same allegation group and specific\n\nallegation codes that are used for mandatory reporting to the\n\nNational Practitioner Data Bank; and\n\n13.
