A company asserting the insurance compliance self-evaluative\n\nprivilege set forth in Section 1 of this act has the burden of\n\ndemonstrating the applicability of the privilege. Once a company\n\nhas established the applicability of the privilege, the party\n\nseeking disclosure under this act has the burden of proving that the\n\nprivilege is asserted in bad faith or for a fraudulent or any other\n\nsimilar improper purpose. The Insurance Commissioner, district\n\nattorney, or Attorney General seeking disclosure under this act has\n\nthe burden of proving the elements set forth in subsection B or C of\n\nSection 2 of this act.\n\nB. The parties may at any time stipulate in proceedings under\n\nSection 2 or 3 of this act to entry of an order directing that\n\nspecific information contained in an insurance compliance self-\n\nevaluative audit document is or is not subject to the privilege\n\nprovided under Section 1 of this act.
