Stat. tit. 36, § 36-6835","heading":"Definitions","body":"As used in this act:\n\n1. \"Insurance compliance audit\" means a voluntary internal\n\nevaluation, review, assessment, audit, or investigation for the\n\npurpose of identifying or preventing noncompliance with, or\n\npromoting compliance with, laws, regulations, orders, or industry or\n\nprofessional standards, which is conducted by or on behalf of a\n\ncompany licensed or regulated under the Oklahoma Insurance Code, or\n\nwhich involves an activity regulated under this Code. Once\n\ninitiated, an audit shall be completed within a reasonable period of\n\ntime. Nothing in this section shall be construed to authorize\n\nuninterrupted or continuous auditing; and\n\n2. \"Insurance compliance self-evaluative audit document\" means\n\ndocuments prepared as a result of or in connection with an insurance\n\ncompliance audit. An insurance compliance self-evaluative audit\n\ndocument may include, but is not limited to, as applicable, field\n\nnotes and records of observations, findings, opinions, suggestions,\n\nconclusions, drafts, memoranda, drawings, photographs, exhibits,\n\ncomputer-generated or electronically recorded information, phone\n\nrecords, maps, charts, graphs, and surveys; provided, this\n\nsupporting information is collected or developed for the primary\n\npurpose and in the course of an insurance compliance audit. An\n\ninsurance compliance self-evaluative audit document also includes,\n\nbut is not limited to, any of the following:\n\na. an insurance compliance audit report prepared by an\n\nauditor, who may be an employee of the company or an\n\nindependent contractor, which may include the scope of\n\nthe audit, the information gained in the audit, and\n\nconclusions and recommendations, with exhibits and\n\nappendices,\n\nb. memoranda and documents analyzing portions or all of\n\nthe insurance compliance audit report and discussing\n\npotential implementation issues,\n\nc. an implementation plan that addresses correcting past\n\nnoncompliance, improving current compliance, and\n\npreventing future noncompliance, or\n\nd. analytic data generated in the course of conducting\n\nthe insurance compliance audit.\n\nDocuments, communications, data, reports or other information\n\nwhich are created as a result of a claim involving personal injury,\n\nproperty damage or workers’ compensation made against an insurance\n\npolicy are not insurance compliance self-evaluative audit documents\n\nand are admissible as evidence in civil, criminal or administrative\n\nproceedings as otherwise provided by applicable rules of evidence or\n\ncivil procedure, subject to any applicable statutory or common-law\n\nprivilege.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e622416e96452f4f85b0848349b32c4af01b4c884e9a55b3e58db858df6f8606","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6834","next":"us-ok/okla.-stat.-tit.-36-36-6836"},"notice":"GroundRules: Original legal text.
