Stat. tit. 36, § 36-6904","heading":"Certification by Insurance Commissioner - Issuance of","body":"certificate.\n\nA. Upon receipt of an application for issuance of a certificate\n\nof authority, the Insurance Commissioner shall within forty-five\n\n(45) days determine whether the applicant, with respect to health\n\ncare services to be furnished, has complied with the provisions of\n\nSection 6907 of this title.\n\nB. The Insurance Commissioner shall, within forty-five (45)\n\ndays of determining compliance or deficiency, issue a certificate of\n\nauthority to a person filing a completed application upon receipt of\n\nthe prescribed fees and upon the Insurance Commissioner's being\n\nsatisfied that:\n\n1. The persons responsible for the conduct of the affairs of\n\nthe applicant are competent and trustworthy, and possess good\n\nreputations;\n\n2. Any deficiency identified has been corrected and the\n\nInsurance Commissioner has determined that the health maintenance\n\norganization's proposed plan of operation meets the requirements of\n\nSection 6907 of this title;\n\n3. The health maintenance organization will effectively provide\n\nor arrange for the provision of basic health care services on a\n\nprepaid basis, through insurance or otherwise, except to the extent\n\nof reasonable requirements for copayments or deductibles, or both;\n\nand\n\n4. The health maintenance organization is in compliance with\n\nthe provisions of Sections 6913 and 6915 of this title.\n\nC. A certificate of authority shall be denied only after the\n\nInsurance Commissioner complies with the requirements of Section\n\n6920 of this act title.
