The powers of a health maintenance organization (HMO)\n\ninclude, but are not limited to, the following:\n\n1. The purchase, lease, construction, renovation, operation or\n\nmaintenance of hospitals, medical facilities, or both, and their\n\nancillary equipment and property reasonably required for its\n\nprincipal office or for purposes necessary to the transaction of the\n\nbusiness of the organization;\n\n2. Transactions between affiliated entities, including loans\n\nand the transfer of responsibility under all provider or subscriber\n\ncontracts between affiliates or between the health maintenance\n\norganization and its parent;\n\n3. The furnishing of health care services through providers,\n\nprovider associations or agents for providers which are under\n\ncontract with or employed by the health maintenance organization;\n\n4. The contracting with a person for the performance on its\n\nbehalf of certain functions such as marketing, enrollment and\n\nadministration;\n\n5. The contracting with an insurance company licensed in this\n\nstate, or with a hospital or medical service corporation authorized\n\nto do business in this state, for the provision of insurance,\n\nindemnity or reimbursement against the cost of health care services\n\nprovided by the health maintenance organization;\n\n6. The offering of other health care services in addition to\n\nbasic health care services. Nonbasic health care services may be\n\noffered by a health maintenance organization on a prepaid basis\n\nwithout offering basic health care services to any group or\n\nindividual; and\n\n7. The joint marketing of products with an insurance company\n\nlicensed in this state or with a hospital or medical service\n\ncorporation authorized to do business in this state as long as the\n\ncompany that is offering each product is clearly identified.\n\nB. 1. A health maintenance organization shall file notice,\n\nwith adequate supporting information, with the Insurance\n\nCommissioner prior to the exercise of any power granted in\n\nparagraphs 1, 2 or 4 of subsection A of this section that may affect\n\nthe financial soundness of the health maintenance organization. The\n\nInsurance Commissioner shall disapprove the exercise of power only\n\nif, in the Insurance Commissioner’s opinion, it would substantially\n\nand adversely affect the financial soundness of the health\n\nmaintenance organization and endanger its ability to meet its\n\nobligations. If the Insurance Commissioner does not disapprove such\n\nexercise of power within sixty (60) days of the filing, it shall be\n\ndeemed approved.\n\n2.
