No premium rate may be used by a health maintenance\n\norganization until such time as a schedule of premium rates or\n\nmethodology for determining premium rates has been filed with and\n\napproved by the Insurance Commissioner. Such premium rates shall be\n\nconfidential and not subject to public disclosure.\n\nB. Either a specific schedule of premium rates or a methodology\n\nfor determining premium rates shall be established in accordance\n\nwith actuarial principles for various categories of enrollees;\n\nprovided, that the premium applicable to an enrollee shall not be\n\nindividually determined based on the status of the enrollee’s\n\nhealth. Provided further, that the premium rates shall not be\n\nexcessive, inadequate, unfair or discriminatory. A certification by\n\na qualified actuary or other qualified person acceptable to the\n\nInsurance Commissioner as to the appropriateness of the use of the\n\nmethodology, based on reasonable assumptions, shall accompany the\n\nfiling along with adequate supporting information.\n\nC. The Insurance Commissioner shall approve the schedule of\n\npremium rates or methodology for determining premium rates if the\n\nrequirements of subsection B of this section are met. If the\n\nInsurance Commissioner disapproves the filing, the Insurance\n\nCommissioner shall notify the health maintenance organization. In\n\nthe notice, the Insurance Commissioner shall specify the reasons for\n\ndisapproval. A hearing will be conducted within thirty (30) days\n\nafter a request in writing by the person filing. If the Insurance\n\nCommissioner does not take action on the schedule or methodology\n\nwithin thirty (30) days of the filing of the schedule or\n\nmethodology, it shall be deemed approved.\n\nD. When contracting with educational entities within the\n\nmeaning of Section 1306 of Title 74 of the Oklahoma Statutes, in\n\nsetting health insurance premiums for active employees and for\n\nretirees under sixty-five (65) years of age, health maintenance\n\norganizations shall set the monthly premium for active employees at\n\na maximum of Ninety Dollars ($90.00) less than the monthly premium\n\nfor retirees under sixty-five (65) years of age.","path":["OK Code","Title 36"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os36.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"be2194dbee205814fe8ff9aa7024c9860179461e6dfbf13a2d93fbc647a622b6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-36-36-6915","next":"us-ok/okla.-stat.-tit.-36-36-6917"},"notice":"GroundRules: Original legal text.
